OP.DINANCE OF THE COUNCIL OF THE c:;:n OP PALO ALTO
TO VALIDATE THE ENAC'IMENT AND ENFORCEMENT OF LOST
ORDINANCE NO. 1316 AND TO PROVIDE LIMITATIONS OF
TIME W:::THIN WHICH ACTIONS MAY BE COMMENCED
WHEREAS, in .accordance with the City Clerk's office records
management plan and Government Code section 340S0.5, the City Clerk
has been microfilming vital records under her control so that
·original document~ can be destroyed, and
. WHEREAS, during ~he course of analyzing City records for
· microfil'ming, th°e .City Clerk has determined that . Ordinance No.
1316 ,, the · 1950 subdivision ordinance, . has been enacted, but that,
following a diligent search of all records w:tde.: the City Clerl<....s
control,. an. executed original copy of the ordinat;-:e cannot be found
and .U3 't herefore deemed .lost, and
WHER'F..AS, in order to permit microfilming and destruction of
cooies of the lost ordinance, it is necessary to validate its
enactment aJld enforcement. • ·'
'l'he Council ·of the City of Palo Alto does ORDAIN as
follows:·
~-Validation. All act.s and proceedings hereto
fore taken by ·or on behalf of the Council under any law, or wider
color of any law, for, or in connection with, the enactment and
enforcement of the ordinance set forth below in Section 4 <:.re
hereby authorized,, c9nfirmed, validated, and declared legally
e-f,fEcti ve; This shall . include all acts and proceedings of: the
Council and . of any person, public officer, board, or agency
heretofore co~ or taken in reliance upon such ordinance.
~~~. Limitations-. (a) This ordinance shall operate
to-supply such, l'<'!gislative authorization as may be necessary to
·authorh:e, ccnfinn, and validate any such acts and proceedings
heretofore taken which the Council or its officers could have
supplied' or provided · for in the law under which such acts o:r
proceeC.ings were tak~n .
(b) This ordinance shall be limited t o ~e validation of
acts and prcceedixi.gs to the extent to which the same can be
ef'fectuated under tbe state and federal constitutions.
. (c) Thia o~dinance shall not operate to authorize,
conf~val.idate, or legalize any act, ~roceeding, or ot her matter
relatj\\ ·:l'. to· the ordinances, the legality of w::iich is being c~nte~~.~~.~or inquired into in any legal proceading now pending and undetei)~ ·• · d or which is pending and undetermined during the period ot: thir (30) clays fro:n and after the effective date of this

effectivf:.i date. of this ordinance; otherwise, t ::ie ordinances and
