COUNCIL OF THE CI'rY OF PALO t'\LTO ADDING SUBSECTION (1) TO SECTION 21.40.050(c) OF THE PALO .l\LTO MUNICIPAL CODE REGULATING 'rfif: CONVERSION OF' RENTAL HOUSING •ro CONDOMINIUMS I"HEREAS, this Council has directed t:bat City Staff evalu­ ate the present Chapter 21.40 of the Palo Alto Municipal Code and to provide its conclusions to tb is Council not later than July 1 1 1981~ and ~·lHER8A.S r this Council wishes t.o minimize the opportunity for condom in i. urn and other conversions du.r.i. nq t:.he 5 taf f study period while allowing consideration of C(Jnversion projects which recognize the City need for and commitment to housinq for low and moderate income persons; NOW, THEREFORE, the Council of the City of Palo ~lto does OHDAIN as follows: SECTION 1, Subsection ( ·1) is hereby added to Sect ion 21. 40··.-fF'>-O(c-·)-o-f the Palo Alto Municipal Code to read as fol­ lows: " ( 1) Further, a.n application for. conversion may be submitted during the moratorium period (a) if the two-t.hirds consent requirement of this subsection is met~ provided that only tenants in lawful poss~:ss ion as of 'November 24 v 1980 at"e e 1 ig ibl e to pr:ov ide their consent for purposes of de term in inq the t~<m-thircs requirement, (b) if assurances a.re provided that all tenants wilJ. have the opportunity to rr:rnain in the converted dwelling as owners or renter·s for the expe<:ted life of the conversion project or thirty years if the project life is greater than thirty (30) years, (c) if the complete application is filed on or before July 1, 1981, and (d) if units equa..;. in number and of comparable size and condition (prior to any rehabilitation done for purposes of conversion) to those proposed fLir conversion are provided 'tlithin the City of Palo J\1 to for· permanent low and moderate income rental housing in accordance with either the City's Below Market Rate Program, the City's Rental Housing Acquisition Program, or such similar program expressly approved by the City Counc i 1 a.s being in accord with the City's Comprehensive Plan goals and objectives for low and modecate income housing. The provision of such low and moderate income rental housinq in accordance with this subsection shall be compliance with· the City below market rate requirement for subdivisions set. forth in the Comprehensive Plan, Program 18, and as thereafter may be amended. SECTION 2. 't'he Council finds th~1t the adoption of this ordin.ance w111 not have any significant advers~: environmental impact. SECTION 3.
