HomeMy WebLinkAboutORD 3217• • ORIGINAL • ORDINANCE NO. 3217 ORDINANCE OF THE COUNCIL OF THE CITY OF PALO ALTO ADDING SECTION 16.20.052 TO THE PALO ALTO MUNICIPAL CODE TO SET FORTH AN EXCEPTION PROCEDURE FOR SIGNS The Council of the City of Palo Alto does ORDAIN as follows: SECTION 1. Section 16.20.052 is hereby added to the Municipal Code tore ad as fol lows : 16~20.052 Exception Procedure. An application for exception from any of the regulations of this chapter may b& made in such form and include such infonnation as the building official may prescribe. Such application shall be accompanied (1) by the written consent of the property owner or other authorized person as set forth in section 16.20.030; and (2) by the application fee set forth in the Municipal Fee Schedule. The application shall be referred to the Architectu~al Review Boai:d who shall r0~v iew it pursuant to the procedures and s tanda r·ds set forth in Chapter 16.48. An exception may be approved if, on applic~tion and/or the facts presented, it j.s found that: (1) there are exceptional or extrao:cdinary circumstances or conditions applic­ able to the property involved that do not apply generally to property in the same district; (2) tht~ granting of the application is neces­ sary for· preservation and enjoyment of a substantial prcper:ty right. of the applicant, and to prevent unreasonabV~ property loss or un~ rwc(~ssary l:<ardships; ( 3) the granting of the application will not be detrimental o:r injurious to property or improvements in the vicinity and will not be detrimental to the public healthr safety, general welfare or convenience.
