One copy of the secondary codes set forth within the Uniform Fire Code, and the amendments set forth in this Chapter, are on file and open to public inspection in the Office of the Fire Department administra­ tive office. Section 2.102 is amended 11 Sec~ 2.102 'I'he Chief, with the approval of the City Manager is authorized to make and enforce such rules and regulations, policies and departmental orders, for the preven~~on and control of fires and fire hazards as may be necessary f~om time to time to car:r.y out the intent of this code. Three certified copies of such rules and regulations policies and departmental orders s~all be filed with the City Clerk and shall be in effect immediately thereafter and additional copies shall be kept in the office of the Fire Department for distribution to the public. - 2 - • • "The procedure for the adoption of such rules and regula­ tions, policies and departmental orders shall be as specified in Section 2.08.050 of the municipal code." 15.04.040 Subsection (c) and (d) are added to Section 2.201. Section 2. 201 is-amended by addrng thereto subst:~ctions (c~ and (d) to read: "(c) All buildings which are deficient in fire and life safety measures to such an extent where in the judgment of the fire chief unusual hazards to life exist due to inadequate or unprotected means of egressr unprotected vertical openings; inadequate means of emergency access either interior or exterior; inadequate provisions for smoke and heat removal or ventilation; inadequate emergency lighting and other emergency power suppliesr inadequate area separations, occupancy separations, compart­ mentation walls or smoke stop partitions; lack of or inadequate f :i.1:e protection equipment, fire a12 rmp emergency commun.ication systems, fire detection devices; or interior finishes, furnishings, ~arpeting equipment o~ processes not in compliance with accept­ able fire safety standards shall for the purpose of this section be declared deficient buildings. The fire chief in cooperation with the building official shall prescribe ~easonable correc- tive m--:asures necessary to abate th0 r'ir:::.ficiencies. Abatement shall be enforced ir1 accordance with estabJ.ished procedures in the Uniform Fire Code and the Palo Alto Municipal Code. "(d) Where i.n the opinion of the fire chief an emergency evacuation plan wil! increase the level of fire and panic saf et.y to the occupant.c~ of a structm:e, the fire chief may ' require that such a plan be posted in a conspicious location and periodic drills be held. Access --Obstructions Prohibited. Access --Parking may be Prohibited. If i.n the judgment of the fire chief it is necessary to prohibit vehicular pa:-king along private accessways in order to keep them clear and unobstructed, he may require the owner, lessee or the person in charge of the premises to paint the curbs red or install signs or giv•; other appropriate notice to the effect that parking is prohibited by the Fire Department. It shall there­ after be unlawful for such owner, lessee or other person in charge to fail to install and maintain in good condition the form of notice so prescribed. -8 - • "When such areas are marked or signed as provided herein, no person shall park or leave standing a vehicle adjacent to any such curb marking or contrary to such sign. Palo Alto Municipal Cede Section 10.60.160 or appropriate State Vehicle Code section are applicable to prosecutions under this section." 15.04.130 Section 10.211 added. Additions to existing buildings --1rhis sectit"'n shall apply to all new construction including additions. 11 (1) If the entire building area exceeds the area permitted in Section 3802(1) through (6), the entire building shall be sprinklered. "(2) If the addition requires an automa.tic sprinkler system by Section 3802(7), but the entire -10 - • building is below the area specified in Section 3802(1) through (6), the additional shall be sprinklered and separated from the existing building by an area separation wall. as specified in Section 505(d). 11 g. (a) The frame or case of the welding machine except internal combustion eng-ine driven machines shall be g.rounded. Ground connections shall be mechanically strong and electrically adequate for the required current. 11 (b) Welding current return circuits from the work t.o the machine shall have proper electrical contact at all joints and periodic inspection shall be to ascertain that proper electric contact is maintained. "(c) When electric c.trc welding or cutting is to be discontinued for any substantial period of time, such as during hmch hour or overnight, all electrodes shall be removed from the holders, the holders shall be carefully located so that accidental con- tact cannot occur, and the machines she,11 be disconnected from the power source." 15.04.200 ~~,Eaph ~ded to Section '79.103.5. is amended by aOcrrng a new paragraph to reacr:- Section 79.103.5 "A permit fee as set forth in the municipal fee schedule shall be charged for the installation of any f lamrrtabJ.e or combustible liquid tank of 120 gallon capacity or more, whether portable or fixedo The fee shall be payable to the City of Palo Alto Fire Department." 15.04.210 Sc-!ction 80~1_03 _(f) is added to read: "Earthg~.ke~riers J..52! Subsection (a) is added to Section 82.102 to re'~"·- "(a) Liquefie{ petroleum gas shall not be stored or used in connection with any public assemblage unless the storage containers, equipment, fittings, and appliances and the place­ ment, use and operation of such equipment complies with the suggested liquefied petroleum gas safety orders of the State of California Department of Industrial Relations. Division of Industrial Safety." -11 - -----------------------------------------------···"-• • 15. 04. 2~rn Paragraph 7 of Appendix E is amended by adding the !£.~lowing p~r~graphs: ''(a) Each chimney used in conjunctions with any fire­ place, barbecue, incinerator or any heating appliance in which solid or liquid fuel is used, upon any building, structure or premises located within 200 feet of any hazardous fire area, shall be maintained with a. spark arrester constructed with heavy wire mesh or other noncombustible material with openings not to exceed 1/2 i.nch. "(b) No person may operate or cause to operate, on or within 200 fl::et of a.ny hazardous fi.::-e are() or in any flarrutH:~ble agricultural crop, without maintaining in effective working order a spark arrester attached to the exhaust system, any tractor 1 E.mginc-., machine, or truck equipmen c wi t:h a.n in t.crnal combustion engine that is ope1:ated on hydro-·carbon fuels in harvesting or moving grain or hay, or O!Jeratei_; f without main­ taining in effective working order a spark arrester attached to the exhaust system, any such equipment or vE:hicle. 11 ( c) Spark arresters attached to the exhaust system of engines or equipment or vehicles as described in this section shall not be placed or mounted in such a rn.anner as to allow flarn(~S or heat from the exhaust system to ignite any flamrnable material." 1.5.04.240 ti 16' CLEARANCE OF BUSH OR VEGE'I'ATION GROW'l'H FROM STRUC'rURES "(a) Any person owning, leasing, controlling, operating or maintaining any building or structure in, upon or adjoining any hazardous fire area, and any person owning, leasing or controlling any land adjacent to such buildings or structures, shall at all times: "l. Maintain around and adjacent to such building or structure an effective firebreak made by removing or clearing away, for a distance therefrom of not less than 30 feet on each side thereof, all flammable ve~retation or other combustible growth. This section shall not apply to single specimens of trees, ornamental shrubbery, or similar plants used as ground covers, provided that they do not form a means of rapidly transmitting fire from the native growth to any structure. 11 2. Maintain around and adjacent to any such building or structure additional fire protection or firebreak made by removing all brush, flammable vegetation, or combustible growth located from 30 feet to 100 feet from such building or structure as may be required by the Chief when he finds that because of extra hazardous conditions a fire­ break of only 30 feet around such structures is not suf­ ficient to provide reasonable fire safety. Grass and other vegetation located more than 30 feet from such building or structure and less than 18 inches in height above the ground may be maintained where necessary to stabilize the soil and prevent erosion. -12 - • • 11 3. In lieu of the provisions of subsections (a) 1 and 2, the owner or other responsible person may, at that person's option, substitute an approved greenbelt composed of appropriate fire retardant plants, subject to approval of the Chief, in the subject areas. "4. R.emove a.ll portions of any trees, shrubs, bushes and other growing vegetation from within 10 feet of the outlet of any chimney. "5. Maintain all trees, sh.rubs, bushes and other growing vegetation or portions thereof adjacent to or overhanging any structu1:-e free of dead l.imbs, branches, deadwood and other combustible matter. 11 6. Maintain the roof of any structure free of leaves, needles, twigs, dead vegetative growth and other combustible material. "(b) In the event that any of the conditions prohibited by Subsection (2) of this Section exist, the Executive Body may instruct the Chief to give notice to the owner of the property upon which such cond.i. ticn exist.;, ..:o correct such prohibited condition and if the owner fails to correct such condition, the Executive Body may causE~ the same to be done and make the expense of such correction a lien upon the prop­ erty upon which such con<li ti.on r:.!xists." 11 2 4.. Fire Protection Re._quirernents. All buildings con­ structed aft:er-·theeffecti\re-aate-·0r-this ordinance within the boundaries of the hazardous f i~·e area of the City of Palo Alto, as defined in this ordinance shall be provided special on-site fire protection. Fire protection ~hall include: 11 1. Access and adequate water supply for emergency fire department operations as required in Article 13 of the Uniform Fire Code; and 11 2. Class A, B or c roof covering as required in. Chapter 14 of the Uniform Building Code as amended; '!3. or, as required by the fi:t:e chief, building con­ struction and design that will restrict fire from spreading throughout the structure from the room of origin for at least 30 minutes. Such design shall include automatic detection of products of combustion other than heat, auto­ matic alarm, automatic door closers and automatic venting of products of combustion." 15.04.260 Section 3.105 added. Violations/Penalties. Any person, firm or corporation VIOiating any provision of this fire code sh al 1 be deemed guilty of a misdemeanor and upon convi(;!tion thereof shall be punishable by a fine not to exceed $500 or by imprisonment. for not to exceed six months, or both fine and imprison­ ment. Each separ.ate day or any portion thereof during which any violation of this firo code occurs or continues shall be deemed to constitute a separate offense, and upon conviction thereof shall be punishable as herein provided. 15.04.270 Enforcement/Citati.on Authori~. The following desig­ m=; ted employee posi tJ,ons may enfor'.::e th'e Trovisions of this chapter by the issuance of citations. Persons employed in such positions are authorized to exercise the authc.ity provided in Penal Code, Section 836.5 and are authorized to issue citations for violations of this chapter. Notwithstanding any other provision of this chapter and the provisions of the Uniform Fire Code, whenever the words "shall" or "must" are used in establishing a responsibility c~ duty of the City, its elected or appointed officers, employees, or agents, it is the legislative intent that such words establish a discretionary responsibility or duty requiring the exercise of judgment and discretion.
