ORDINANCE NO. 3209
ORDINANCE OF ,,,BE COUNCIL OF THE CITY OF PALO ALTO
AMENDING SECTION 9.56.030.(17), (_18) OF THE PALO
ALTO MUNICIPAL CODE REGARDING PROPERTY MAINTENANCE
STANDARDS
The Council of the City cf Palo Alto does ORDAIN as follows:
SECTION 1. Sect.ion 9. 56 e 0 3 0 ( 17) I { 18) is hereby n.mended to
read as follows~ crr1e following i terns are declared to :Oe public
nuisances.)
"tl7) The storage or keeping of any used
or unused building material in a location out
of doors for more than thirty days within a
year, provided that nothing herein shall:
r1(A) Make lawful any such storage when it
is prohibited by othe~ ordinances or laws;
"(B) Prohibit such storage upon tho
premises of a bona fide lumber yard or other
dealer in building materials wl1en the same is
permitted under the zoning code ana other
applicabJ.e laws;
"(Cl Prohibit such storage for 90 days
when done in conjunction with the construction
project for which a valid bu:~lding pe:rrni t is
in effect if required and which is being
prosecuted diligently to completion; E-..xten
sions for additional periods of tin1e may be
granted by the building official when addi
tional storage time in n~cessary and upon
proof that such construction project will be
diligently puxsued.
rThe term 'buildinq materials' as userl
herein shall mean and include lumber, plumbing
materials, wallboard, sheet metal plaster, brick,
cement, cor.crete block, ·roofing materials, cans
of paint and similar materi21ls.
"(18) The storage or keeping in a location
out of qoors of any unused and abandoned open
pit or excavation, building foundation, automobile,
trailer, housetrailer, boat or other vehicle or
major parts thereof o Without limiting the forf'l
going, any such thing stored or kept for a period
in excess of thirty dnys in a year shall be pre
swned to be unused and abandoned for pu:cposes of
this provision."
SECTION 2~ The Council finds that this is not a project
undertfie Cali'fornia Envirorunental Quality Act and, therefore~
no environm~ntal impact assesSll\ent is necessary.

SECTION 3'. This ordinance shall become effective upon the
commencement of the thirty..-first day after the day of its passage.
