HomeMy WebLinkAboutORD 3204• OR~CINAL ORDINAi~CE NO. 3204 ----- ORDINANCE OF THE COUNCIL OF THE CITY O.F PALO ALTO AMENDING SECTION 18.94.070 (c} (3), (4) OF '£HE PALO ALSO MUNICIPAL CODE REGARDING REQUIRED TERMINATION OF NONCONFORMING USES The Council o~ the City of Palo Alto does ORDAIN as follows: SECTION l, Section 18.94.070 (c) (3) f (4) is hereby amended to read as-· f 0110\:/s: 11 18.94.0?0(c) t.3) Upon the date set for hearing, the .. . Planning Comrrri..ssiori shall conduct a public hearing thereon, unless, for cause the Conunission shall on the date continue the matter. Upon conclusion of the hearing, the Conunission shall determine whether th-:.> use of the property on July 20, 1978 is compatible apd not detrimental to the land uses designated in the Comprehensive Plan for the surrounding ar2as of properties. In the event the Commission so finds, it shall recommend to the City Council that the use shall be excepted from the termina-+.:Lo11 provisions of this section. The Commission may r"'co1:1mend such conditions as it may find ne~essnty ~o insure com- pa ti bi li ty including, b•·.r not limited tor r~quired improvement of or modif.i.\.:ations to existing improve= ments on the property, limitations on hours of opera­ tion, limitation on the nat~ra of operations, and a specified term of yea~s for which the exception shall be granted. "(4) Upon receipt of the recommendation of the Planning Conmission, City Council shall co~sider the application within a reasonable time. The council may, at jts option, conduct a public hearing on the matter. "In the event the Council find!=> the use of the subje~I,;. property to be compatible with and not jetrimental to those land uses designated in the Comprehensive Plan for the surrounding ~rea and proper~i~s, it shall, by motion, except said use from the t~rmi~ation provisions of this section. In granting such axception, the Council may include sue~ conditions as are deemed neces­ sary to insure such compatibility, in~ludin-:;, "lut not limited to, the conditions set out in (c~ (3) above."
