Chapter 9.S7 is hereby added to the Municipal code to read as follows: Chapter 9.57 ~arcotics ParRphcrnalia-Sale and Display 9.S7.010 Definition. narcotics Paraphernalia. For purposes of this chapter "Narcot1.csParapher nalia rr consists of any device, con­ trivance, instrument or parapher~alia for smoking or injecting, or consuming ma:r.i ju"mu, hashish, PCP, or any cont:colled substance, as defined in the l~ealth and Safety Code of the State of California, other than prescript.i::l-. drugs and devices to L,gest or inject. presc?:iption drugs. This definition includes, but is not linited to, such items as coke spoons, water pipes, hash pipes, roach clips, and opium pipes. This definition does not ir1clude cigarette ?ape:s or cigarette rolling machines. 9.57.020 11inors Restricted. No person, including, but not limited to, an ovmer, manager, proprietor 1 or ::;alcspersor1 of any place 0~ ~usine~s selling or displaying for the purpose of sale any narcotics paraphernalia, shall sell or permit to be sold any narcotics parapher­ nalia to any person under the age of eighteen years. 9. 57.030 Sale and Display Rooms. No person shall J:;ell or offer for sale at any place or business to which t.he pnblic is invited narcotics paraphernalia, except within a separate room or enclosure to which minors under the age of eighteen years who are not accompanied by a parent or legal guardian are excluded. Each entrance to s~ch room or enclosure shall have a si'Jn posted with reasonably visible and legible words to the effect that (1) narcotics paraphernalia are being offered for sale in such room or enclosure; and (2) minors under age eighteen years are excluded unless accompanied by a parent or legal guardian~ No person Bhall permit any minor under the age of eighteen years to enter, visit, 01: remain in any snch room or enclosure unless such minor is accompanied by a parent or :egal quardian. 9.57.040 Public Nuisance. Any violation of this chapter shall be a public nursance and may be abated in a~cordance with Chapter 9. 56 of this Code and/or Section 731 of the Code of Civil Procedure. 9.57.050 Violations. Violations of Sections 9.57.020 and/or 9.57.030 shall be a misdemeanor. SECTION 2. The Counci~ of the City of Palo Alto finds that this is not a project and, therefore, no environmentai impact assessment is necessary. SECTION 3. This ordinance shall become e.ffective upon the commence­ ment of the thirty-first 1ay after th~ day of its passaae.
