HomeMy WebLinkAboutORD 3182,_ • • ORIGINAL ORDINANCE NO. 3182 ORDINANCE OF TP.E COUNCIL OF THE CI~Y OF PALO ALTO AMENDING SECTION 18.08.040 OF THE PALO ALTO MUNI­ CIPAL CODE (THE ZONING r·tAP) TO CHANGE THE CLASSI­ FIC!".'riON OF PROPERTY KNOWN AS 727 AND 744 RAMONA STREET FROM R?<1-3 (C) AND CS TO PC The Council of the City of Palo Alto does ORDAIN as follows: SECTION l. Section 18.08.040 of tl1e Palo Alto Municipal Code, the "Zon1ng Map," is hereby amended by changing the zoning of certain property known as 744 Ra"llona Street (Parcel A) from CS (Service Commercial) and 727 Ramona Street (Parcel B) from Multiple Family Re~idential with Civic Center Combining District Regulations to PC (Planned Cummunity District Regulations). Said property is shown on a map attached hereto as Exhibit "A" and incorporated herein by ref­ erence. SECTIO~ 2. The City Council hereby finds with respect to the subject property that: a. The sites are so situated, And the uses proposed for the sites are of such characteristics that the application of general districts will not provide sufficient fl.ex­ ibility to allow the proposed development; b. Development of the sites under the provisinL~ cf i:.i1e PC (Plu)~,ned Community District-), will result in public bene­ fits not oth'"rwl r>e ~ttainable by application of the regu­ lations of general districts or combining dist.ricts 1 in­ cluding: 1. The proposed p~uject will be provided at the site in close proximity to shopping facilities, public services and public transportation. ·c. The uses within the proposed PC are consistent with the Comprehensive Plan and compatible with adjoir:ing sites. d. The project will not have a significant impact on the environment. e. The change of district is required for the p-ubli.: interest, convenience and general welfare. SECTION 3. The diagrams entitled '1Torn Harrington" attached hereto as EXhibit "B" constitute the devGlopment plans and are incorporated herein by reference. Said development plan is ap­ proved pursuant to Section 18.68.120 of the Palo Alto Municipal Cede, subject to the following conditions: a. Use. The prDject consists of two (2) sites which are de­ fined as follow~: l. '/44 Ramona Street (Parcel A) : A tote:.! of three ( 3) residential units plus commercial and office space as shown on the attached improvement plans with a total of t\velve (12) parking spaces (10 stand3.J::'d and 2 com­ pact), six (6) of the spaces to be provided for U&P by the occupants of the renidential units, and six to be used in connection with the business and office use. No parking will be allowed in the required drive- way and backout areas. · -· . .. • .. (. .. • • 2. 727 Ramona Street (Parcel B): a t0tal of two (2) residential units located above a total of ten ~10) parking spaces (five standard and five compact) as shown on the approved improvement plans. Four (4) spaces are being provided for the two residential units, with the ~emaining six (6) to be used for commer.cial and office space at 744 Ramona Street:. b. Improvements. 1. All improvements and development shall be substantially in accordance with the approved development plans with all applicable codes and ordinances; and with the re­ quirements of the Director of Public Works/Engineering, the Director of Utilities and the Chief of the Palo Alto Police Department. 2, The landscaping should be in accordance with the land­ scape plan as approved by the Architectural Review Board. 3. Landscaping within the private areas is exempt from this PC development plan as shown on the improvement plans. 4. gff-Street Parking. A total of 22 off··street parking spaces shall be provided \ith this deve~opment. 5. Dav~lopment Schedu~~· No certificate of occupancy w1ll be issued for any use on the property until con­ struction of the parking required in connection with that use is completed. Parcel A: (i) Begin constructi0n within six (6) months of effec­ tive date of PC ordinance. ( ii) Complete construction wi thiit eighteen ( 18) months of effective date of the PC ordinance. Parcel B: (i) Begin construction within six (6) months of effec­ tive date of PC ordinance. (ii) Complete construction within eighteen (18) months of starting date. SECTION 4.
