ORDINANCE NO. 3176 ---'----
ORDINANCE OF THE COUNCIL OF THE CITY OF PALO ALTO
APPROVING AND ADOPTING A PLAN FOR THE CONSTRUCTION
OF FENCE IMPROVEMENTS IN BYXBEE PARK
WHEREAS, Article VIII of the Charter of the City of Palo Alto and
Section 22.08.005 of the Palo Alto Municip~l Code require that before any
substantial building, construction, reconstruction or development is com
mencGd or approved upon or with respect to any land held b~· the City for
park purposes, the Council sh~ll first c~use to be crepared and by ordi
nance approve and adopt a plan therefor; and
WHEREAS, the City Council did by Ordinance l'~o. 2252, ~dopt"':!d in 1965,
place Byxbee Park on the list of lands used or in tl..'nd~."d to be used for
park purposes; and
WHEREAS, the Council desires to allow certain fence imorovements to
be accomplished in Byxb•ee Park which are necessan' to secl:.re the Flood
Basin area from tntrusion of unauthorized motorized vehicles; and
WHEREAS, the fence will prevent such vehicles from ontoring the
flood basin; and
WHEREAS, the project was unanimously approved under Section 18.82 of
tha ~alo Alto Municipal Code (Site and Desifn Review) by the Planning
Commission and the Architectural Review Board.
NOW, THEREFORE, the Council of the City of Palo Alto does ORDAIN as
follows:
SECTION l. The document attached hereto, marked EXHIBIT "A," he:r"eby
is approved and adopted as additional park improvements pursuant to
Section 22.08.005 of the Palo Alto Municipal Code.
SECTION 2. The project was reviewed for environmental impact prior
to action on the said Site and Design review and found to be catego.1Jcal:y
exempt (ClaBs 4).
SECTION 3. This ordinance shall become effective immediately as
provided in Section 12 of Article III of the Charter and Section 2.04.375
of the P~lo Alto Muniuipal Code.
