ORDINANCE OF ThE COUNCIL Of ~HE CITY OF PALO ALTO
AMENDING CHAPTER 9.14 OF THE PALO ALTO MUNICIPAL CODE TO ADD
PROVISIONS PROHIBITING SMOKING IN PUBLIC AkEAS OF RSTAIL STORES,
PERSONAL SERVICE HUSINESSES, NON-PROFIT ENTITY Uf'F ICES, GENERAL

The Council of the City ot Palo Alto aoes ORDAIN as follows:
SECTION 1. Section 9.14 .010 of tne Palo Alto Municipal Code
is hereby amended by adding two new subsections thereto which
shall be numbered and shall read a~ ~ollows:
(i) "Nonprofit ~ntity" means any corporation,
unincorporated association, or other entity created
for charitable, educational 1 political, social, o~
other similar purposes, tne net proceeds from the
operations of which are committed to the promotion of
the objects or purposes of the organization and not
to private financial gain. A public agBncy is not a
non-profit organization witnin the mean1ng of this
section.
(j) "Tobacco store" means a retail store utilized
primarily for the sale of tobacco products and
accessories and in which the sale of other products is
incidental.
SECTION 2. Section 9.14.095 is hereby added to the Palo Alto
Munic1pal Code and shall read as follows:
9.14.095 S.Oking Prohibited in Public Areas at
various Businesses and Retail Stores. Smoking is
prohibited and unlawful in all areas of the following
establishments which are available and customc.rily
open to the general p0llic: ·
1. Retail stores, except tobacco stores.
2. All personal service businesses as defined in
Section 18.04.030 of this Code.
3. All general business offices as defined by
Section 18.04.030(61) of this Code.
4. All non-profit entity offices.
5. All professional offices as defined by Section
18.040.030(116) of this Code.

7. Bus and train shelters.
8. Transportation terminals as defined by Section
1~.04.030(137) of this Code.
SECTION 3. section 9.14.096 is hereby added ta the Palo ~lto
Munic1pal Code; it shall read as follows:
9.14.096 Cardroc:. exception. Notwith
standing any other provison of this Ch<lpt~r, smoking
may be permitted 1n cardrooms licensed pursuant to Chapter
4.52 of this Code.
SECTION 4. Severability. If any section, subsection,
subdivision, paragraph, sentencer clause or phrase ot this
ordinance or any part tnereof is for any reason held to be
unconstitutional, such decision shall not affect the valid1ty of
the remaining portion of this ordinance or any part thereof.
SECTION 5. The Council finds that this project is
categorically exempt trom the requirements of the California
Envrionmental Quality ~ct and does not require an environmental
assessment.
SEC'riON 6. This ordinance snall become effective u:pon the
commencement of the thirty-first day after the day of its
passage.
