ORDINANCE OF THE COUNCIL OF THE CITY OF PALO ALTO
AMENDING ORDINANCE 3266 REGARDING 27 UNIVEHSITY AVENU~

The Council of the City of Palo Alto does ORDAIN as follows:
t
SECTION 1. The City Council hereby finds with respect to the
subject property that:
(a) The site is so situated, and the use proposed for the
site is of such characteristics that the application of general
districts or combining districts will not provide sufficient
flexibility to allow the proposed development in that the property
is presently zoned Planned Community and minor modifications to
that zone district are requested.
(b) Development of the site under the provisions of the
Planned Community district will result in public benefits not
otherwise attainable by application of general districts or
combining districts and the proposed take-out window, modifying
the current Planned Community district, will provide services to
patrons of the restaurant operation in a more convenient location,
will provide short term parking for take-out food patrons, will
solve an existing problem of illegal parking alongside the
adjacent bicycle path, and will upgrade bicycle parking.
(c) The use permitted, and the site development regulations
applicable within the district, are consistent with the Palo Alto
Comprehensive Plan and are compatible with existing potential uses
on adjoining sites or within the general vicinity in that the
relocation of take-out food service and provision of additional
short term parkin~ tor this use will improve the current situation
of take-out patrons searching for parking on adjacent sites or
within the street right-of-way.
SECTION 2. The plans attached hereto as Exhibit •A•
const1tute the development plan and are incorporated hereby by
this reference to Exhibit •A". Said developwent plan is approved
pursuant to Section 18.68.120 of the Palo Alto Municipal Code.
SECTION 3. Uses. The allowable use shali be limited to
restaurant use authorized un4er Planned Community Ordinance
i3266, with ancillary take-out foOd service.
SECTION 4. Improvements and regulations.
(a) The project is subject to the April 17, 1987, conditions
of the Handicap Appeals Board as listed in Exhibit B.
(b) The applicant shall install a ballard and chain barrier
two feet from the inside edge of the adjoining bicycle path as
shown on the approved project plans in Exhibit A. The bollard

barrier shall be installed and approved by the City's
Transportation Division prior to the use of the take-out window.
(c) For employee and valet parking, the applicant shall
lease twenty-two (22) parking spaces or the number of parking
spaces available for $600.00 a month, whichever is less expensive,
in the existing parking lot located betwee~ the eastern boundary
of the Holiday Inn and the Southern Pacific railroad tracks (Lot
U). The applicant shall encourage parking of employees in this
area to free existing on-site parking spaces for patrons. This
condition shall become effective only upon City lease of the
off-site parking lot.
(d) Irrigation heads in the rear parking area shall be
oriented away from the trunks of the existing mature live oak and
black oak. Area around the trees shall remain well drained.
(e) Parking requirements for Planned Community Ordinance
13266 shall be increased to 75. Two spaces shall be provided and
designated for short term parking of take-out patrons. Long term
use of these spaces by employees or other restaurant patrons shall
be prohibited and enfc~ced by the restaurant operator. Parking of
restaurant vehicles, such as vans or mobile coo~ing units, shall
be prohibited in the required 7~ parking spaces.
(f) Planned Community Ordinance 43266 shall be modified to
require seven Class II bicycle parking spaces. The final design
of these spaces shall be approved by the Transportation DivisiQn
prior to issuance of a building permit and the bicycle pa~king
facilities shall be installed prior to the use of the take-out
window.
SECTION 5. Development schedule. Construction shall begin
within six months of the approval of the application by the City
Council and shall be completed within three months of the start of
construction.
SECTION 6~ The Council finds thai thi~ project is
categorically exempt from the California Environmental Quality
Act.
SEC'riON 7. Thi~ ordinance shall become effective upon the
commencement of the thirty-first day after the day of its
passage.

At the Handicap Appeals Board meeting on April 17. 1987, the following requests
were made concerning the ~·ro Go" operation and handicap access to the building in general.
l. Provide signage at the 11 To Go" window area directing handicap people to the main entrance for service.
2. Provide signage at main entrancEe instructing patrons that "To Go" orders may be placed at the Hostess Station .•
3. Instruct employees in writing the procedures to follow when waiting on handicap patrons.
' 4. Instruct valet parking attendants concerning usage of the handicap parking space at the front entrance.
5. Install pipe bolhrds adjacent to the ~r handi~ap parking space.
6. Instal 1 the required handicap s1gnege at the handicap parking spaces.
The applicant is to return to the Handicap Appeals Board at the May 15, 1987 ,_
meeting to infonn the Board on the progress made in comp1ying with the fore-going items. ·
