HomeMy WebLinkAboutORD 3757• • ORDINANCE NO. 3757 \ ORDINANCE OF THE COUNCIL OF THE ~ITY OF PALO ALTO AMENDING TITLE 18 (ZONING CODE) REGARDING RECYCLING CENTERS The Council of the City of Palo Alto does ORbAIN as follows: SECTION l. Section 18.04.030 (121) [Definitions] of the Palo Alto Municipal Code is hereby renumbered to Section 18.04.030 ~ (119). SECTION 2. Section 18.04.030 (120) [Definitions] is hereby added to the Palo Alto Municipal Code to read: (120) "Recycling Center" means facilities appurtenant and exterior to an otherwise allowed use, which are utilized for collection of recyclable materials such as metal, glass, plastic, and paper stored in mobile vehicles or t~ailers, permanent storage units, or in bulk reverse vending machines exceeding 50 cubic feet in size. SECTION 3. Sections 18.04.030 (122), (123) and (124) [DefinitroriSTof the Palo Alto Municipal Code are herebi' renumbered to (121), (122} and (123). SECTION 4. Section 18.04.030 (124) [Definitions] is hereby added to the Palo Alto Municipal Code to read: (124) "Reverse vending machine" means a mechanical device which accepts one or more types of empty beverage containers and issues a cash refund or credit slip. SECTION 5. Section 18.41.030 (j) [CN District] of the Palo Alto Mun1c1pal Code is h~reby renumbered to ~8.41.030 (k) SECTION 6. Sections·ia.41.030 (j) [CN District] is hereby added to the Palo Alto Munfcipal Code to read: (j) Reverse vending machines, supject to regula- tions established by Chapter 18.88 · SECTION 7. Section 18.41.040 (p) [CN District] is hereby added to the Palo Alto Municipal Code to read: (p) Recycling centers. S~CTION. 8. Section 18.41.050 (m) [CN District] of the Palo Alto Municipal Code is hereby amended to read: l. ; . • • (m) Outdoor Sales and Storage. All permitted office and commercial activities shall be conducted within a building, except for (1) incidental sales and display of plant materials and garden supplies occupying not more than 46.5 square meters (500 square feet) of exterior sales and display area, (2) farmers' markets which have obtained a conditional use permit, and (3) recycling centers which have obtained a conditional use permit.' SECTION 9. Sections 18~43.030 (r) [CC District] of the Palo Alto Municipal Code is hereby renumbered to 18.43.030 (s). SECTION 10. Section 18.43.030 (r} [CC Distr.ict] is hereby added to the Palo Alto Municipal Code to read: (r) Reverse vending machine, subject to regula­ tions established by Chapter 18.88. SECTION 11. Section 18.43.040 {n) (CC District) is hereby added to the Palo Alto Municipal Cods to read: (p) Recycling centers. SECTION 12. Section 18.43.050 (k) [CC District] of the Palo Alto Municipal-Code is hereby amended to read: (k) Outdoor Sales and Storage. Subsection 18.45.0SO(k)(S)' {CS District] is hereby added to the Palo Alto Municipal Code to read: (k}(S) Recycling center.s must obtain a conditional use permit. SECTION 17. Section 18.49.050 [CD District] of the Palo Alto Municipal Code is hereby amended to add the following u~es to the matrix, in alphabetical o~der: Uses Recycling centers Reverse vending machines CD-C Conditional Permitted co--s CD-N Conditional Conditional Permitted Permitted SECTION 18. Section 18949.070{a) [CD District] of the Palo Alto Municipal Code is hereby amended to read: {k) Outdoor Sales and Storage. Except in shopping centers, all permitted office and commercial activities shall he conducted within a building, except for (1) incidental sales and display of plant materials and garden supplies occupying no more than 186 square ~eters (2,000 square feet) of exterior sales and display area, (2) outdoor eating areas operated incidental to permitted eating and drinking ~ervices, ( 3) far11.ers' markets which have obtained a conditional use permit, and (4) recycling centers which have obtained a conditional use permit. Any permitted outdoor activity in e:itcess of l86 square meters (2,000 square feet} shall be subject to a conditional use permit. Exterior storage shall be prohibited, except as provided under (4) above. SECTION 19. sections 18.55.030(q), (r) anq (s) [GM District] of the Palo Alto Municipal Code are hereby renumbered to (r), (s) and ( t). Section 18.SS.050(k)(3) [GM District} 0 the Palo Alto Municipal Code is hereby a~ended to read: (k)~l) Exterior storage shall be prohibited, unless screened by a solid wall or fence of between 1.5 and 2.4 meters (5 and 8 feet} in height. This requirement is not applicable to recycling centers. SECTION 23. Sections 18.57.030(rn), (n) and (o) [GM(B) District} of the Palo Alto Municipal Code are hereby renumbered to 18.57.030 (n), (o) and (p}. S~CTION 24. Section 1B.57.030(m) [GM(B) District] is hereby added to the Palo Alto Municipal Code to read: (m) Reverse vending machines, subject to regula­ tions established by Chapter 18.S8. SECTION 25. Sections 18. 58.040(p), {q) and (r) [GM( l) District} of the Palo Alto Municipal Code are hereby renumbered to 16.58.040 (q), (r) and (s). SECTION 27. Sections 18.60.0JO{i) and (j) {LM District] of the Palo Alto Municipal Code are hereby renumbered to 18.60.0JO(j) ~nd ( k). Section 18.60.050(k) [LH District] of the Palo Alto Municipal Code is hereby aJ1ended to read: (k) Outdoor Activity. All uses and activities shall be conducted within a building except the following permitted outdoor activities or uses: (1) Outdoor activities associated with residential use; (2) Landscaping; (3) Parking and loading facilitiest (4) Recycling centers, which have obtained a conditional use permit; {5) Nonco-.ercial recreational activities ~nd facilities accessory to permitted or con­ ditional uses; and (6) Activities and facilities accessory to con­ ditional uses, when authorized by a condi­ tional use permit. SECTION 33. Section 18.8).080 (Off~Street Parking] of the Palo Alto Municipal Code is hereby amended to add the following use to the table, in alphabetical order: Use Miniaum Off-Street Parking Requiremen~ Minimum Bi~ycle Parkins Requirement Recycling center 1 space for each attendant a SECTION 34. SECTION 35. The Council hereby finds that this ordinance will have no s19nif icant adverse environmental impact. SECTION 36. This ordinance shall become effective upon the commencement of the thirty-first day after the day of its passage.
