ORDINANCE NO. 37JJ
ORDINANCE OF THE COUNCIL OF THE CITY OF PALO ALTO
APPROVING ANO ADOPTING f'LANS FOR THE SEISMIC
REINFORCEMEN'r OF FOO'fHILLS PARK DAM
WHEREAS, Article VIII of the Charter of the City of Palo Alto
and Section 22.08.005 of the Palo Alto Municipal Code require that
before any substantial building, construction, reconstruction, or
development is commenced or approved, upon or with respect to any
land held by the City for park purposes, the Council shall ficst
cause to be prepared and by ordinance approve and adopt a plan
therefor; and
WHEREAS, the City Council did by Ordinance 2252, adopted in
1965, place Foothills Park, ~nd additions ·co Foothills Park.
("Foothills Park") on a list of lands used or intended t<:> be used
for park purposes: and
WHEREAS, the Alternate Embankment Design he~eafter described
was recommended for approval by the Arc hi teet ural Review Board
(ARB) and the concept foL the improvements was previously approved
by the Planning Commission and the modifications were referred by
the City Council back to the ARB, pursuant to Chapter 18.82 of the
Palo Alto Municipal Code (Site and Design Review); and
WHEREAS, the Council desires to allow improvements for the
seismic reinforcemE:nt of Foothills Park Dam to be built within
said park pursuant to a plan prepared therefor;
NOW, THEREFORE, the Council of the City of Palo Alto does
ORDAIN as follows:
SECTION l. The plan attach~d hereto, marked •Attachment A•,
and cons1st1ng of two pages shall be and the same is hereby
approved and adopted.
SECTION 2. The Council finds thC<t this project will have no
sigriif1cant environmental impact.
SECTION 3. · This ordinance shall become ~ffeptive upon the
commencement of the thirty-first day after the da'y of its
passage ..
