ORDINANCE OF THE COUNCIL OF THE CITY' OF PALO ALTO
AMENDING SECTION 18 .. 08 .. 040 OF THE-PALO ALTO
MUNICIPAL CODE .(THE ZONING MAP) TO CHANGE THE.
CLASSIFICATION OF THE PROPERTY KNOWNAS
9 22-9 24 BAUTISTA COURT FROM R._ 2 TO PC
The Council of the City of Palo Alto does ORDAIN as follows:
SECTION 1. Section 18.08.040 of the Palo Alto Municipal
C()de, the "Zoning Map," is hereby amended by changing the zoning
of the cer-tain property known as 922-924 Bautista. Court from R-2
(Two Family Residence District) to PC (Planned Community
District). Said property is shown on the map attached hereto,
marked Exhibit A and incorporated herein by this cef.erence.
SECTION 2. The City Council hereby finds with respect to the
subject property that:
(a) The application of general or combining dis
tricts to the site of the proposed development plan will
not provide sufficient flexibility for the development
of a duplex structure having separate ownership of each
unit.
. (b) The development plan provides public benefits
not otherwise obtainable by .application of general dis
.tricts in that two dwelling units of a size suitable for
family occupancy will be provided for sale to low and
moderate income purchasers under the provisions of the
Below Market Rate (BMR) Housing Progr~m.
.. ·(c) The uses-allowed under the propo'sed PC Dis.~:-
trict are cons'i sttertt· .with tl)e Co.mprehensi ve Plan and ·
compatible w.ith adjoining sitfl!s · .i,n that the size and
pr'icing '<if the units will ·sa.tisfy the·· City's pol icy for
ptovi-sion .of lo.w. cost family dwellings and will be of a
design which will not detract . from the de,velopment of
surrounding p~operties.
{d) The. change of district is required for the
public interest, convenience and general welfare.
SECTION 3. ·Development Plan. The plan attached hereto. as
Exhibit B constitutes the development plan and is incorr;>ora ted
herein by this reference. Said · developm~nt plan is approved
pursuarit to Section 18.68.120 of the Palo Alto Municipal Code.
SECTION 4. Regu.iatiods.. (a) uses.. Allowable us~s shall be
1 imi ted to s1ngle · family residential occupancy by each separatEt
dwelling unit.

(b) Special Requirement~. 1. The duple :X: units
will be ini ti,ally sold u!'lder the BMR Housing Program· at
prices not to exceed One· Hundred and ··Ten Thousand
Dollars ($110,000) per unit •. Any modifiGation qf this
condition will require approval of the City Co unci 1~
2. Plumbing shall ,be prefitted to permit the
future addition of solar panels.
3.. Separate utility connections· for each unit
shall be provided by the developer.
4. The minimum floor elevation of the structure
shall be seven-point-five {7.5) feet above mean sea
level.
5. Landscaping sha 11 be installed in accordance
with the approved landscape plan {see Ex:hibit B) and
shall be maintained and replaced as necessary to assure
normal growth, health and groomed appearance.
6. Nothing contained herein shall prohibit the
owners of the duplex units from making minor changes to
the structures or landscaping, without amending the
development plan, provided that the changes comply with
the site development regulations established for the R-1
District or other city requirements normally affecting
single family residences.
(c) Development Schedule. Construction shall be
gin no latec than six (6) months after the date of City
Council approval and Shall be compl~ted within nine (9)
a~onths of the issuance of a building permit.
SECTION 5. The ·council finds that .this project will have no
signif1cant adverse environmental impact •.
