ORDINANCE OF THE COUNCIL Of THE CITY Of PALO AlTO
N1ENOING THE BUDGET FOR THE FISCAl YEAR 1986-87 TO PROVIDE
FOR AN ADDITIONAL APPROPRIATION FOR AH ENVIRONMENTAL ANAlYSIS Of THE
REG1·1NAL WATER QUALITY CONTROL PLAAT EFFLUENT lOCATION
WHEREAS. pursuant to too provisions of Section 12 of Article HI of the
Charter of the City of Palo Alto, the Council on June 23, 1986 did adopt a budget
for fiscal year 1986-87; and
WHEREAS, in OecemiJer 1985, City staff reca.ended that an enviromaental
analysis of the existing Water Quality Control Plant Oischar•Je loc!thln be con
ducted to document the environmental effects of the effluent; and
WHEREAS, an appropriation of One Hundred Thousand Dollars ($100,000) was
approved in the 1986-87 budget to conduct this analysis; and
WHEREAS, on August 4, 1986 Counci 1 unanimously approved the selection of
James M. Montgomery, Inc. to perform the ~nvironmental analysis of the discharge
location; and
WHEREAS, the agreement wit.. James M. MontgOftllery, Inc. is for One Hundred
Sixty Seven Thousand Six Hundred fifty Dollars ($167 .650) which includes the
costs of fieldwork ~hich was unknown prior to the deve1opEnt of the scope of
work, and
WHEREAS, staff rec~nds that 15 percent of the contract a110unt. i.e.,
T~enty-Five Thousand Dollars {$25.000) ~ be set aside for contingencies in the
event of change orders cr a~ndsents;
NOW, THEREFORE, the Council of the City of Palo Alto does ordain as
follows:
SECTION .1. The sura of Ninety-Two Thou~nd S1x Hundred Fifty Dollars
($92,650) be appropriated to the Engineering ~ogra• of the wastewater Trea•nt
Utility and the Reser'le for System ZIIProve~~ent in the Waste..ater Fund is corres ...
pondingly decreased.
SECTION 2. The Council finds that this h not a project for purposes of the
California Environmental Quality Ac:t and. therefore, no environaental iiiPilct
assessment. is necessary.
SECTION 3. This ordinance shall beca.e effective i~iately as provided in
Sectio'l 12 of Article III of the Charter.and Section 2.04.375 of the Palo Alto
Muni ci pa 1 Code.
