HomeMy WebLinkAboutORD 3718• • ORDINANCE -NO. 3718 ORDINANCE OF THE COUNCIL OF THE CITY OF PALO ALTO REPEALING THE MORATORIUM ON CERTAIN DEVELOPMENT AND DEMOLITION OF HISTORIC STRUCTURES/SITES IN THE DOWNTOWN A[{EA AND DECLARING AN EMERGENCY WHEREAS, the City CouPcil adopted a moratorium ordinance restricting certain development of and demolition of historic structures/sites in the downtown area, until an amended historic preservation ordinance could be adopted: and WHEREAS, an amended historic preservation ordinance (Chapter 16.49) has been introduced and passed and will become effective on December 11, 1986~ and WHEREAS, Ordinance #3699, the moratorium ordinance, is to be in effect until February 28, 1987, unless sooner repealed by the City Council; and WHEREAS, it is essential to the proper administration of the city regulations on this subject, that the moratorium be repealed before or on the effective date of the amended historic preservation ordinance so there is no confusio1~ about applicable law. NOW, THEREFORE, the City Council of the City of Palo Alto does ORDAIN as follows: SECTION 1. The moratorium imposed by Ordinance t3699 on certain development and demoli~ion of historic structures in the downtown area is repealed, eff•ctive on December 11, 1986, or the effective date of the historic presirvation ordinance (Chapter 16. 49) 1 adopted by the counc~l at first reading on October 27, 198.&, whichever occurs later~. SECTION 2. The Council fi·nds that none of the provisions of thls ord1nance will have a significant environm~~tal impact. SECTION 3. Based ·on the reasons set forth· above,. the Council declares that the repeal of the moratorium imposed by Ordinance 3699, is necessary as an emergency measure to· protect the publi~ peace, health and safety ~nd shall be effective· immediate!~, upon its adoption.
