EMERGENCY ORDINANCE OF THE COUNCIL
OF Ttie Clf'i OF PALO ALTO AMENDING PORTIONS OF' TI'rL'Ii! l?
OF THE PALO ALTO MUNICIPM .. CODE TO CONFOM TO PROVISIONS
Of tHE H~ALTtJ AND SAFETY CODE OF THE STATE OF CALIFORNIA AND
CONTAI"ING A STAr,EMENT OFTHE REASONS FOR ITS URGENCY
WdEREAS, the City of Palo Alto has adopted comprehensive regu
lations dealing w~th the inventory unagement and storage of
hazardous aaterials; and
WHEREAS, the City of Palo Alto has sought to maintain uniformity
between its require~ents and those of neighboring jurisdictions in
the County of S~nta Clara; and
~HEREAS, the State Legislature has added Chapter 6.95 to
Division 20 of the Health and Safety Code p~oviding for hazardous
materials release response plans and inventory; and
~HERB~s, the require~ents of said Chapter include provisions for
cities to designate themselves as the local administering agency for
the impleMentation of said Chapter; and
WHEREAS, said Chapter provides an exemption from regulations
adopted by the State Departeent of Health Services for cities and
counti·~s which have had an effect on September :t, 1985, a local
ordinance containing business inventory reporting requirements
substantially si•ilar to said Chapter and which have adopted, not
later than October 21, 1986, a•end•ents providing for business plans
which are the sa•e as or .are restrictive than said Chapter1 and
WHEREAS, the City is assuNing responsibility within its juris
dictiora for ieple•enting said Chapter by separate resolution; and
WHEREAS, the City Council does hereby find that i-mplementation
of said Chapter and exe~ption fro• said regulations will preserve the
public peace, health and safety within the City;
NOW, THERt:FORE, the Coucil of the City of Palo Alto does hereby
ORDAIN a$ follows~
SECTION 1. Subsection ( k) of Section 17 .16. 020 of the .Palo
Alto Municipal Code is hereby a•ended to read as follows:
(k) V.ariation And Inforaation.
(1) AdditiPnal infor•ation aay be required for the HMMP
where such infor.ation is reasonably necessary to meet the
intent of this title~
(2) When~ver permitee has submitted a plan which includes
substantially the saae information as is required for aoy
