ORDINANCE NO. 3701 ·
ORDINANCE OF THE COUNCIL OF THE CITY OF PALO ALTO
AMENDING TtTLE 21 (SUBDIVISIONS) REGARDING THE
MERGER OF FOUR OR FEWER SUBSTANDARf• .· R-1 tOTS
WHEREAS, the Cityts subdivision ordinan1-:e (Title 21} classi
fies a subdivision creating or removing lot lines between four or
fewer lots as a minor subdivision which may be acted upon by the
director of planning and community enviro~ment~ but
~~HEREAS, the City•s subdivision ordinance r-equires any pre
liminary parcel map for a minor subdivision with exceptions to the
requirements and regulations of Title 21 to be granted only by the
City Council1 and
WHEREAS, frequently the merger of adjacent substandard R-1
lots, though resulting in lots in greater compliance wit;l the
zoning regulations, st i 11 results in a preliminary pa reel map with
an exception: and
WHEREAS, the City wishes to narrow the ~efinition of an
exception in the subdivision ordinance in order to encourage the
merger of adjacent substandard R-1 lots.
NOW', THEREFORE, the Council of the City of Palo Alto does
ORDAIN as follows:
SECTION 1. Sections 21.04.030(17)-(37) of the Palo Alto
Municipal Code are hereby r~numbered to sections 21.04. 030 ( 18).,.
( 39).
SECTION 2. Section 21•04.030{17) is hereby added to.the Palo
Alto Municipal Code to read:
( 17) • Exception • means an exception to any of the
require•ents for lot width, lot depth, lot area, street
frontage or access, as set, forth in titles 18. or 2 i,
provided that a preliminary parcel map that merges four
or fewer substandard R-1 lots into a parcel or parc&ls
in · greater compliance with the requirements o·f ·· lot
width, depth o~ area set forth in title 18' than any of
the previous lots shall not be considered an exception.
SECTION 3. The Co unci 1 h~reby finds that ttli s ord ina nee
will "fiaV"e no significant adverse environmental impact.
SECTION 4. This ordinance shall become effective upon the
commencement of the thirty-first day after the day. of its passage;,
