'; ,• : . ',. ',;r'l ·,' .·: ': 1',,. "' The Council of the City of Palo Alto does ORDAIN as follows: SECTION 1. Section 18 .. 08.040 of the ·Palo Alto Municip~l Code.}. 'th.~':·:;:::·i ·, "Zonin9 Map," is hereby amended. by modification of PC District 1643 f.dr -:·::. property known as 1161 Em~arcadero Road. Said property is shb~n o~ a map attached hereto as Exhibit A and inciorporated herein by referende~ SECTION 2. The City Council hereby finds, with respect to the subject property, that: ( 1 ) Tne c\f>Pl icat ion bining district exists on the district. of a general zone district or com­ is not appropriate because the use site pursuant to an existing PC (2} The proposed use (gasoline sales) and the site development regulations ~ppl icable with in this PC district are consistent with the Falo Alto Compre­ hensiv~ Plan and are compatible with existing ~nd potential uses on adjoining sites and the general vicinity in that the proposed use is nearly iden­ tical to the existing use, and the site is located next. to a neighborhood shopping center and small office building and is located near a major freeway access. Provisions have been incorporated into the proposed project ~o minimize the potential nuisance of ni9ht-time noise and light glare which may be experienced by. adjacent residents locat~d across Embarcadero Road: ' SEC~ION J. Hours of operation for the operation shall be limited to 6:00a.m. to 11:00 p.a. Fuel deliveries shall be permitteo during hours when the site is not open for business. (2) All site activities shall compl~ with the provisions of Title 17 (Haza~dous Materials Stotage) aMd Chapter 9.10 (~oise) of the Palo Alto Municipal Code~ (3} Air, water, and restroom facilities shall be available to customers during hours of operation. (c) Improvements. (1} All improvements and development shall be substantially in accordance ~ith the ap­ proved development plans, with all appli­ cable codes and ordinances, and with the requirements of the Director of Public Works/Engineering, the Director of Utili­ ties, and the Chief of the Palo Alto Fire Department. (2) The western driveway shall be designated as an ~Exit~ only and the eastern drive­ way shall be designated as an ~Entranceft only, with the exception that fuel de­ livery vehicles may use the exit for ac­ cess during hours when the site is not open for business. (3) A street opening permit shall be pbtained from the Public ',;~orks/Engineering Depart­ •ent for all work done witt1in the . public right of way.
