' .... r. i ~If\ L ~-·'• -~ ;:;· ..• '-\ ORDINANCE NO. 3698_ ORDINANCE OF THE COUNCIL OF THE CITY OF PAW ALTO AMENDING SECTION 18.08.040 OF THE PALO ALTO MUNICIP~L CODE {THE ZONING MAP) TO CHANGE T"dE ZONE CLASSIFICATION OF THE PROPERTIES KNOWN AS 215-239 HIGH STREET FROM CC ro RM-3 The Council of the City of Palo Alto does ORDAIN as follows: SECTION 1. Section 18.08.040 of the Palo Alto Municipal Code, the "Zoning Map," is hereby amended by changing the zoning of the properties known as 215-239 High Street fcom CC {Community Commercial District) to RM-3 (Multiple Family Residence District), as shown on the map attached hereto, marked Exhibit A and incorpo­ rated herein by this reference. SECTION 2. Two-family uses and multiple-family uses dxisting on theeff'ecti.ve date of thi~ ordinance and which, prior to that date, were lawful conformi 109 permit ted uses or conditional uses operating pursuant to a conditional use permit shall be permit ted to remodel, improve or replace site iw._?rovements on the same site, without necessity to comply with site development regulations for continual use and occupancy by the same use; provided that for any such remodeling, improvement or replacement: (a) the inc:.."~ased floor area shall not be greater than five percent ( 5%) of the floor area existing on the effective date of this ordinance:. and (b) the number of dwelling units shall not be increased; and (c) any portion of the site abutting a site in any RE, R-:-1, R-2, RM or any. PC d.istrict permitting sinqle famil}t or multiple family development shall maintain a minimum interior yard of 3.0 meters ( 10 feet), shall maintain a solid wall or fence .between 1. 5 and 2. 4 me.ters ( 5 and 8 feet) in height alon9 the CO'-on site line and shall maintain the minimum interior yard as a landscaped screen; and (d) for any site abutting a site in any RE, R-1, R-2,. RM or any PC district permitting single family or multiple fa•ily devel­ opment, any permit ted expansion shall be subject to a mazi•um height established by daylight planes that are identical to the daylight plane requirements of the most restrictive residential district abutting each such side or rear site line. Such daylight planes shall begin at the applicable side or rear site lines and increase at the required slope from these site lines until inter­ secting the maximum height 1\mit of the existing structures on the site. .. 1.,., • SECTION 3. The Council finds that the rezoning of the above properties is consistent with the adopted Comprehensive Plan of the City of Palo Alto. SECTION 4. The Counci 1 hereby finds that this change will have no significant adverse environmental impact. SECTION 5. This ordinance shall become effective upon the commencement of the thirty-first day after the day of its passage.
