ORDiNANCE NO. 3688 ORDINANCE OF THE COUNCIL 01-' THE CITY OF PALO Al.TO AMENDING SECTIO~ 18 .. 08.040 OF THE PALO ALTO MUNICIPAL CODE (THE ZONING (II!AP) TO CHANGE THE CLASSIFICATION OF PROPERTY KNOWN AS 2047 EAST BAYSBORE FRONTAGE ROAD/111 LAURA LANE FR0M GM(B) TO PC The Council of the City of Palo Alto does ORDAIN as follows: SECTION 1. Section 18.08.040 of the Palo Alto Municipal Code, the "Zoning ~~ap," is hereby amended by changing the zoning of certain property known as 2047 East Bayshore Frontage Road/111 Laura Lane from GM(B) (General Manufacturing District) to PC (Planned Community District). Said property is shown on a map attached hereto as Exnibit A and incor-porated herein by reference. SECTION 2. The City Council her.eby finds, with respect to the subjP.ct property, that: ( 1) Application of the parking general zoning districts will cient flexibility to allow the the proposed development, mini requirements under not provide suf fi­ use of the site for self-storage units. { 2) Development of the site under the provisions of the PC (planned community district) will result in public benefits not otherwise att&inable · by ap­ plication of the regulations of genei"al districts or combining districts in that the proposed· mini­ stot·age facility will reduce peak hour +:raffic generation from that currently created by existing uses. Peak hour traffic generation is critical in the areas utilizing the intersection of Embar­ cadero/East Bayshore which operates at Level of Service D dur·ing the PM peak hour .. ( 3) The proposec;1 use is consistent with the Palo Alto Comprehensive Plan Employment Program lb which intends to li~nit t·ezonings in areas of existing traffic congestion where such rezontngs increase traffic generation and with Transportation Policy 6 which states "Reduce travel at peak hours." The proposed use is also compatible with commerc.ial and industrial uses in the vicinity. SECTION 3. Development ~lan. Said development plan is approved pur.suant to Section 18.68.120 of the Palo Alto Municipal Code. SECTION 4. Regulations. (a) Uses. shall be limited to the follo~ing: (1) Permitted uses (i) Self-storage units for the stor3ge of items common­ ly associated ~ith residential or commercial uses, but excluding the storage, wholesale sale or dis­ tribution of manufactured products, supplies and equipment or materials or ~tor:age of materials which a~e hazardous, flammable or explosive. (ii) Residential units occupied by employees of the facility. (b) Hours of Operation. Hours of operation self-storage operation shall be limited a.m. to 8:00 p.m. fo~ the to 7:00 (c) Below Market Rate Units. (l) Two (2) Beiow Market Rate (BMR) units will be provided on the site in conformc>.nce with the approved plans attached as Exhibit B and incorporated hendn by z::-eference. ( 2) The BMR ur.i t s sha 11 be rented in accordance with the BMR Rental Guidelines (attached her~to as Exhibit C and incorporated herein by reference). ( 3) Tenant selection shall be made by Bayshore Associ­ ates subject to income certification of the first tenants by the Palo Alto Housing Corporation, and therea ft?r at the time ::.>f change of occupancy .. ( 4) The owner of the property shall supply an annual r:eport to the Department of Planning and Community Environment, City of Pa].o Alto, verifyin,g the Occu­ pants• income and rental rates of th~. ~~","' units in conformance wi..th the most current BMR Rental Guide­ lines. (5) the obligation to maintian the two (2) units as BMR rental ur.i ts ~hall remain as long as the property continue~ to be used in conformance with the terms and condit~0ns set ~orth in this ordinance and shall .t.e binding on 'the heirs and successors of Bayshn~e A~$ociates~ (d) Improvements. (2) Developer shall pay for undergrounding of utilities or relocatior. of power poles and overhead lines. (3) Developer shall construct an underground storm line to the nearest adequal~ system, which is located at the head of the Laura Lane cul-de-sac. Drainage shall be designed with detention on-site. Drainage system is subject to the approval of the City Engineer, and shall be installed pcior to new cone~ruction on the site. (4) The design of the development shall comply with tho flood insurance rate map critet"ia. All habitable first floor levels sh(\11 be at or above elevation seven (7.0) feet. ( 5) The applicant shall construct str.eet improvements along the frontage of the site. Improvements shall include curb, gutter and sidewalks. ,\ handicapped ramp shall be provided at the corner of Laura Lane and .East Bayshore E't·ontage Road. Where utility poles are in the sidewalk alignment, the sidewalk shall be widened on northeast side to provide forty-eight inch (48•) minimum clearance. ( 6) Bonds shall be requir-ed of the developer for all off-site improvements, including drainage improve­ ments, prior to issuance of a building permit. ( 7) Au toma t1c fire sprinklers shall be insta !led. (B) Trees planted alongaide emergency fire access shall not restrict ingress or egress of fire apparatus. (9) A final landscape plan, including fence and light­ ing designs, shall be approved by the Arc hi tee tural Revi~w Board pr.-ior to issuance of a building per­ mit. ( 10) All site landscaping shall be installed according to species and size shown on the final landscape plan, and shall be replaced as necessary in accord with the approved landscape plan. SECTION 5. Development Schedule. Construction shall begin withi'n"six (6) months of Council approval and be completed within seven ( 7) months of the issuanc.~ of a building permit. 3. -.· ,,· .• SECTION 6.
