ORDINANCE OF 'l'BE.<>COUNCIL OF THE C.ITY OF PALO ALTO
MANDATING· AUTOt.fOBILE ·L·IABILI'i'Y INSURANCE· ON SCHOOL
BUSES . OPE.l:\::\:'ED .· BY SERVICE ··PROVi-DERs . I.JNDER CITY
CONTRALJ..· ."'ND DECLARING AI.~ EMERGENCY
WHEREAS, the City Council is concerned about the ability of ser
vice providers under City contract to provide adequate insurance on
school buses which they operate~ and
WHEREAS, these prov~iers have not been able to find carriers who
will insure school buses which they utilize in providing their services
and will have to cease using school buses if no solution is found; and
. WHEREAS, if the City Council mandates appropriate automobile lia
bility ins11rance coverage by ordinance for school buses operated by
these service providers, they wi 11 be able to obtain afforda .... .a.e insur
ance under the Californi~ Co·mmercial Insurance Plan~
NOW, THEREFORE, the Council of the City of Palo Alto does ORDAIN
as follows:
SECTION i. Within thirty days after the effective date of this
ordinance, all service providers who operate school butJe.s in conj\,lnc
tion with· services funded t.mder a contract with the City of Palo Alto·
. :;hall,, at their sole cost ~nd e~ense, obtain and maintain in full
force and effect throughout the term of any contract with the City
comprehensiv~S: automobile liability insurance within at .1-aast the·
following lim~ts: ·

California Vehicle Code:,~ §545. Satisfactory evidence of said insuraru::e

SECTION, 2 •. The Council finds that thi$ is not a project under th~
CaliJornla tnvi.ronmental Quality Act and, t'h~refore, no environ11~ntal
i~pac,. assessment is nece&saey.
SEC'l'lOW 3. Based em the reasons set forth abOve, the Council de
clares, that ·the enactmen\: Qf this <>rdinance is n~c~3sary as an. eJJer
gency measure to ptotect. the .public peace, health, and safety and shall
be effe(;tive bnmediately upon adoption.
