ORDINANCE OF THE COUNCIL OF 'l'HE CITY
OF PALO ALTO AMt:NDING SECTION 4.10. 060
Of THE PALO ALTO MUNICIPAL CODE RELATING
TO THE DEt-'INITlON at· AUCTIONEER
WHEREAS, in 19SS, the provisions of ~ection 4.10.060 of the Palo
Alto Munici~al Code (the current section governing the business and
licensing of auctioneers), becar.1e partially inoperative due to changes
in Section 5714(cl of the Husiness and Professions Code; and
WHERSt\S, some of the p!:"ovisions of Section 4.10.060 of the Palo
Alto Municipal Code have been supe~cedad by Section 5714{c) of the
Business and Professions Code;
NOW, THEREFO~E, the Council of the City ot Palo Alto does ORDAIN
as follows:
SECTION 1. The Council hereby a~ends subsection (a) of Section
4.10.060 of t.'h'e Pale Alto t1unicipal Code to r-ead as follows:
4~10.060 Auctioneer. !a) An auctioneer is any
person who sells or otters to~ sale any real or
p~r~onal p~ope~ty at auction (exclusive of court
sales) o~ who carries on the hudiness o~ a~ctioneer
and wnose per':!!_§l~t. place of bus i l)ess, as it
appears on tne 1 icens-e document issue<J by the
C~lifornia Auctioneer Commission, is located within
th-e CitX of Palo Alto. ~---·---
SECTION 2. The Council hereby repeals subsection (c) of Section
4.10.060 of th~ Palo alto Municipal Code in its entirity because the
provisions ot that subsection have been preempted by state law.
SECTlON .3. T~e £ouncil finds that this is not a p~oject under the
California P.nvironia~iital Quality Act and~ therefore, no environmental
impact assessment is necessary.
SECTION 4. This o~dinance shall uecome effective upon the
commencement of the thi.rt:y·-first day after. the day of its passage.
