' ~'--'~ ,. :.~ ~ ·~ ll ~ ·~ • •-;.-•o:· ORDINANCE NO~ 36Q§ ORDINANCE OF THE COUNCIL 01:'~ THE CITY' OF PALO ALTO AMENDING CHAPTER 16. 4 7 REGARDING APPROVAL OF PRO­ JECTS WITH IMPACTS ON HOUSING TO ADO PENALTIES FOR VIOLATIONS WHER8AS, on July 23, 1984, the City Council adopted the Housing Mitigation Ordinance {Ordinance No. 3560) which requires developers of commercial and indust.ria.l space to provide housing units or-in­ lieu payments; a~d WHEREAS, the Council has asked staff to return with an amendme~t providing for penalti8s for violation of the ordinance; ~OW, THEREFORE, t~e Council of the City of Palo Alto do~3 ORDAIN as follows: SECTION 1. Section 16.47.050 of the Palo Alto Municipal Code is hereby renumbered ro 16~47.060. SECTION 2. Section 16.47.050 is her~by added to the Pale: Alto ~unicipal Code to read as follows: 16.47.050 Penalties. (a) All remedies provided for i:1 this chapter. sha 11 be cumulative dnd not excl~sive. (b) Violation of any prov1s1on of this chapter, including but not limi-t;~d to converting an exempt w:;e to a non..,.t::~xempt use' without tender­ ing the appropiate housing mitigation t~ the City, is a misdemea!"lor p1.mishable as provided in this code. (c) Each person or entity is guilty of a separate offense for each ,'nd every day during any portion of which any violation of any provi­ sion of thi& chapter is comrni t ted, <;anti nued o~ permitted by such per&on or e11tity and shall be ~unished accordingly. (d) Any person or entity vfolatin<J any pro­ vision of thi~ chapter, including but not limited to convertinCJ an exempt use to a non-exempt use without tender in9 the appropriate housing mtt. itJ~­ tion to the City,-may t~ liable civilly in a sum not to exceed five ht.'•:'ld:-ed dollars for. each day in which such violation occurs. (e) Persons employed in the following designated employe~ positions are ~uthorized to exercise the authority \provided in Penal Code Sect ion 8 36. 5 and are author. i zed to issue ci ta­ tions for violations of this chapter1 chief building official, assistant chief building official, and ordinance compliance i~spector. SECTION 3. The Council finds that this project will have no si(~nificant adverse environrnental impact. SECTION 4.
