HomeMy WebLinkAboutORD 3478' ORDINANCE NO. 3478 ORDINANCE OF THE COill~CIL OF TH~·CITY OF PALO ALTO AUTHORIZING CLOSI~G OF THE BUDGET FOR FISCAL YEAR 1982-83 WHEREAS, pursuant to the provisions of Article III, Section 12 of th~~ Charter of the City o t Palo Alto and as set forth in Sect ion 2.28.070 of the Palo Alto Municipal Code the Council on June 21, 1982, did adopt a budget for: fiscal year 1982-83; and further on June 27 r 1983, did adopt a budget for fiscal year 1983-H4; and WHERE&S, fiscal year 1982-83 has now ended and the financial re­ sult~, although subject to post-audit adjustment are now available and are herewith t:epoJ:ted in summarized financial ~-> ta temen t-.s prepared by the City Controller which are attached hereto, and by reference made a part hereof; and WHEREAS, pursuant to Section 2.28.080 of tne Palo Alto Municipal Code, the City Controller did amend the budgetary accounts of the City o[ Palo Alto as shown on the attached Staterne:-tt 11 8 11 to reflect: (A) Additional appropriations authorized by ordinance of the City Council. (B) Amendments to employee compensation plans adopted by the City Council. (C) Transfers of appropriations from the contingent account as authorized by the City Manager (D) dedisttibution of appropriations between divisions, programs, and objects within various departments as authorized by the City Manager:. (E) 1982-83 appropriations which on July 1, 1983, were encumbered by properly executed, but uncompleted, purcha.se or.de:r s or:· contracts; and WHEREAS, Article II:! Section 12, of the Charter of the City of Palo Alto requires City Council approval of additional app~opriations ot transfers of appropriations from one department to another; and WHEREAS, 1982-83 appr:opt iations in certain departments and cate­ gories as shown on the attached Statement "B," while not obligated by purchase order:· or contract, at year-end are nevertheless r:ecommended for re-appr.op~iations in the 1983-84 budget. NOW, THEREFORE, the Council of the City of Palo Alto dO(.S ORDAIN as follows; SECTION 1. The City Controller is authorized and directed to in­ c:rease, if necessary, authorizations in the utilities funds by amounts sufficient to provide for purchase of additional water, gas, electric, and refuse collection services, in the event the sales of said utili­ ties services exceed the original estimates contained in t.he 1982-83 budget. ~----~~ ----.-~---------------------------~ • SECTION 2. That 1982-a3 appropriations for the depc:u:t.ments and ca tegot· res showr; on Statement "B" be ca·c ~:· ied fo:c\~ard and added to the 1983-84 budget. SECTION ~. The City Controller is fur:the·r authorized and direc- ted: (A) To close the 1982-83 budget accounts in all funds and depart­ ments as summarized on Stai;;.ements "A,11 "'B,n and "D" and to make such inter-fund t ~:ansfer s as requ ir=ed by the Charte·c of the C i t.y of Palo Alto, by ordinance, or as set forth in the 1982-83 and 1983-84 budgets as adopted or amended. (B) To establish t:eser.ves as sr~t forth on Statement !icu in the amounts shown or as necessary to p~ovide for: { ·1) A res,~nre for r.e-appropr iations in the various funds, the purpose of which is to carry fot'ward and continue in effect the unexpended balance of appropriations for: {a) Capital projects which were not completed as of June 30, 1983. (b) Outstanding purchase orders and contracts for which goods or services have not been received or completed by the last day of fiscal year 1982-83~ Such appropria­ tions shall be carried forward and added to the 1983-84 budget. (c) 1982-83 departmental expenditures which were authorized to be carried forward in Section 2 above. ( 2) Reserves f. or self-insut:ance "lnd replacement of stores inventory in accordance with ordinance and policy guidelines. (3) Reserves for utilities plant replacement and system improvement in accordance with Charter and pol icy guide 1 ines and based upon a report of utilities plant additions, donations, removals, and depreciation prepared by the Department of Utilities. (4) A reserve for working capital in the general and utili­ ties funds in an amount that appro:.dmates their average accounts re­ ceivable balance. (5) A rese~ve for general contingencies equal to ten percent (10%) of general funds expenditures authorized for 1983-84 rounded up to the next hundred thousand dollar amount or s•Jch other amount the City Council may direct. (6) A reserve for interest during construction for the Calaveras Project. -2- • • {7) Aftex providing fot the foregoing reserves, transfer the remainder of the 1982-83 revenue to the reserve for capital projects~ SECTION 4. That upon completion of the independent audit, de- tailed financial statements giving effect to all the above sections be published as part. of the annual financial report of the City as re­ quired by Article Ill, Section 16, of the Charter of the City of Palo Alto. SECTION 5. The Council of the City of Palo Alto hereby finds that the enactment of this ordinance is not a project under the California Environmental Quality Act and, therefore, no environmental impact assessment is necessary. SECTION 6. As provided in subsection (3) of Section 2.04.375 of the Palo "ATto ~1unicipal Code~ this O:t'dinance shall become effective upon adoption.
