ORDINANCE OF THE COUNCIL OF THE CITY OF PALO ALTO
APPROVING AMENDMENT OF THE SCHEDULE! OF PROJECT
PARTICIPANTS AND TRANSMISSION SERVICE SHARES rflliCH
IS A PART OF THAT CERTAIN AGREEMENT FOR CONSTRUC
TION, OPERATION AND FINANCING OF TRANSMISSION
PR~JECT NUMBER ONE DATED AS OP JULY 1, 1983, BY
AND BETWEEN NORTHERN CA.LIFORNIA POWER AGENCY AND
CERTAIN PARTICIPATING MEMBERS
WHEREAS, the Council of the City of Palo Alto has approved that
certain Agreement for Construction, Operation and Financing of Trans
tni ss ion Project Number One, dated as of July 1 , 19 8 3 ~ by and between
the Northern California Power Agency and certain Participating Members
(the "Transmission Agreement"); and
WHEREAS, this City Council finds and determines that it is in the
best interests of the customers of the electric system of the City for
the City to increase its pa:t'Licipation under said ':rransm:l .s.ion Agree
ment;
NOW, •rHERF.:FORE, the Council of the City of Palo Alto does ORDAIN
as follows:
SECTION 1. An amendment of the "Schedule of Project Parti,:ipantl:i
and Tra:nsmiss1on Service Shares'" .increasing Palo Altots Transmission
Service Share by a percentage which reflects an increased participation
of up to 3.5 MW is hereby approved.
SECTION 2. The Mayor is he~eby authorized to execute and deliver
any and ail documents necessary to reflect the said increase.
SECTION 3. Pur~uant. to Section 54241 of the Government Code of
the State' of California, this ordinance is subject. to the provisi,;)ns
for referendum applicable to the City.
SECTION 4. The City Clerk shall certify to the enactment of this
ordinance and shall cause this ordinance to be published in accordance
with Section 54242 of the Government Code of the State of California.
SEC'!' ION 5. This ordinance shall become effective upon the com
menc~ment 6f the thirty-fi~st day after the day of its passage.
