IMPOSING A MORATORIUM F'OR SIX MONTHS ON ISBIJANCE
OF CONDITIONAL USE PERMITS r'OR SECOND lJETACHED
SINGLE-FAMILY DWE:LLING UNI'l'8 IN THE P-1 DISTRICTS
AND DECLARING AN BMERG8NCY
wm~REAS, Ute City Council is concerned about the issuance -:>f con
ditional use permits for large second detached sin9le-ta.mily d.1elling
u n.i ts in the R-1 Districts under Palo Al to Municipal Code ~ct ion
18.12.040{h); and

and placement of second detached sinyle-family dwelling units in
single-family districts to det.0.rmine if these units run counter to the

and
WHBREAS, the issuance of conditional use permits for large second
detached single-family dwelliny units during the study would impede the
worth of the study; and
WHirnEAS, the con st :ruction of lari;ie second detached si n9le-.t ami ly
dwelliny units during the study would adversely affect the peace,
health, and safety of the neighborhoodB in which such units were
located;
NOW, THERE.PORE, the Council ot the City uf Palo Alto does ORDAIN
as follows:
SECTION 1. A moratorium is imposed on the issuance of conditional
use permits for second detached single-family dwelling units which are
9reater than one story, in excess of fiZte~n (15) feet high, as measur
ed to the highest po.int of the building, or (Wer. 1, 000 square feet in
the R-1 Districts under Palo Alto Municipa 1 Co~e Saction 18.12.040(h),
while a study of said units is prepared b}' the City Planning staff in
conjunction with the Planning Conunission.
SECTION 2. Th.is moratorium shall be in ef feet for six months com
mencing on the e.ffect2.ve date of this ordinance unless soon~r termi
nated by the Council.
~ECTION 3. The City staff, in conjunction with the Planning Com
mission, shall preparo a study of second detached single-family dwell
ing uni ts in the R.-1 Districts. The study sha 11 inc 1 ude, but. is not
limited to, the following:
A review of the purpose and impact of second de
tached sin~91e-f.amily dwelling units in R-1 Dis
tricts a.nd a compilation of. data setting forth the

number of ap~lications for and conditional use per
mits issued for second detached single-family
dwelling units in the R-1 Districts, including the
location and size of such uni ts• The study srial.l
make reci::>mmendat ions on the appropriate regulations
for second detached single-family dwelling units in
R-1 Districts.
SECT.ION 4. The Council finds that this project will have no sig~
n if i cant-adverse environmental impact. ·

imposed hereby is necessary as an urgency measure to protect the public
peace, health, and safety and shall be effective irnmediately upon adop-
tion.
This ordinance was introduced and passed at a regular meeting ot
the Coun~il of the City of Palo Alto on Monday, September ii, lqBJ, and
was passed by a four /f if tbs vote o:t al 1 Council members present at the
meeting as follows:
