HomeMy WebLinkAboutORD 3461~---~---------~ -----~-~-------~~~-----~--------------- • • ORDINANCE: NO. 3 4 61 ORDINANCE OF THE COUNCIL OF THE CITY OF PALO ALTO AMENDING TITLE 2 OF THE PALO ALTO MUNICIPAL COD€ TO ADU CHAPTBR 2. 1 0 RELATING 'rO THE AWARD BY ORDINANCE OF CABLE TELEVISION SYSTEM FRANCHISES BY THE CITY COUNCIL WHEREAS, the C.i. ty Council has placed on the November. 8, 1983 ballot a measure authorizing the Council to grant fran­ chises for cable television, and WHBREAS, the City Council desires to have a procedure in place for the granting of one or more cable television system franchises if said measure passes, which procedure would specifically require that any cable television franchises will be granted by ordinance; NOW THBREFORE, the Council of the City of Palo Alto does ORDAIN as follows: Section 1. The Palo Alto Municipal Code antended by addTng to 'l'i tle 2 thereof, Chapter ;! ~ 10 the award of cable television system franchises, to and to read as follows~ Chapter 2 .. 10 is her.eby relating to be n.umbered CABLE TBIJNISIOif SYS'J.'BJIS -AWAlW OF FRANCHISES BY CITY COUHCIL Sections: 2 .. 10.010 2.10.020 Def1nitions Granting of Franchises by City Council. 2 ... Uh010 Definitions: For the purposes of this chapter, ~cable Television System• or ~systemM shall mean any facility operating by means of coaxial cable, optical fiber, or other transmission lines or forms of transmission, and associated equipment. and devices, the primary function of which is to receive and to distribute, through any means, including, ~ith­ out limitation, coaxial cable 1 optical fiber, or satellite or microwave transmission, the signals of one or more broadcast television or radio stations or o£ other r:;c·,.lrces of video, atldio, voice, or data signals. Said facility ma,y also be one which distributes to, from, or among subscribers or other persons such other video, audio, voice, or data signals as may origin.3te within the City or elsewhere. 2.10 .. 020 Granting of Prancbiaes by City Council. Th~ City Council may grant one or more nonexclusive, revocable franchises to c,~matruct, operate, and maintain a Cable T"ele­ v is ion Syst~m in the City. Said grant shall be made by ·adop­ tion of a separate ordinance by the City Council and shall be ------------·~----------------------------------~------------------------------------------· • • on such terms and conditions as may be specified in sai~ sepa~ rate ordinance and a franchise ag~eement enteted into between the City and the franchisee. Except as provided in the City Charter:, no person shall construct~, opet:ate, or maintain a Cable Television System in the city without a franchise granted by sepa[ate ordinance by the City Council~ Section 2.. 'l'he Counci 1 hereby finds that none of the provisons-of-·this ordinance will have a significant envit:onmen­ t a 1 iilipact. Section 3. This O!dinance shall take effect on the effect.ive<Yate of that certain Measun~ relating to amending the City Charter to give the Council authority to grant franchises for: Cable Tel>.wi.sion to be voted upon by the electors of Palo Alto on Novembet 8, 1983. If such measure is not adopted~ this ordinance will be of no force or effect.
