ORDINANCE OF THE COUNCIL OF THE-CI'r·y OF PALO ALTO
AMENDING SECTION 18.08.040 OF THE PALO ALTO MUNICI
PAL CODE (TBE ZONING MAP) TO CHANGE THE CLASSIFICA
'riON OF PROPERTY KNOWN AS OOWN'l~OWN PARKING ASSESS
MENT DISTRICT PARKING LOT Q FROM PF {PUBLIC FACILI-
TIES) TO PC (PLANNED COMMUNITY)
The Council of the City of Palo Alto does ORDAIN as follows:
SECTION 1. Section 18.08.040 of the Palo Alto Municipal Code, the
"Zoning Map;""-is hereby amended by changing the zoning of certain prop
erty known as Downtown Parking Assessment District Parking Lot Q from
PF (Public Facilities Distd.(~t) to PC (Planned Community Distt·ict).
Said property is shown on a map at t :lched hereto as Exb ib it "A 11 and in
corporated herein by reference.
SECTION 2. The City Council hereby finds with respect to the sub
ject PDOPerty~that:
(a) The site is so situated and the uses px·oposed
for the site an:: of such characteristics, that the ap
plication of general districts or combining districts
will not provide sufficient flexibility to allow the
proposed air rights development in that the residential
density and the floor area. ratio of the PF District or
of an alter:native CC (Com.rnunity Commex:ciaJ.) District
would not allow sufficient numbers of residential units
in an air. rights development at tb is location to off set
the substan t i a.l COl-3ts of 1:eplac i ng and expand inq the
public parking supply.
(b) Development of the site under the provisions
of the PC (Planned Community) District will result :in
public benefits not other-wise obtainable by application
cf regulations of gE>neral districts or combining dis
tricts in that the increr.lse of. density and floor arGa
ratio will permit development of residential units af
fordable to households that otherwise are extremely
limited in their. financial •'lbility to purchase housing
in Palo Alto. ·r~~e project will provide the fut:ther
public benefit of an augmented supply of between 50 and
62 additional public parking spaces.
(c) The USt! or l~ses pet.-.;~:. :..€d and the site devel
opment regul aL ions applicable with :i.n the d.istr i c:t shall
be consistent wi.th the Palo Alto Comprehensive Plan and
shC-'11 be compatible with existing and potential uses on
adjoining sites or within the general vicinity in that
the proposed residential, commercial r.lnd parking uses in
this p1~oject will be compatible with the two adjacent
office bu.ild.inqs under construction as well as with the
hotel and religious meeting hall across High Street and
the Southern Pacific northbound passenger platform
across Alma Street fr'om the project. In addition, the
Comtnehensive Plan specifically encouraqes air rights
p~:ojecb>.

Sdid ric~vc~.lopment plan is approved pursuant to S~ct:ton 18.68.120 of the

(b) Parking and Loading Req,!;l~ments
1. Widt.h of the aisles between standard size
parking stalls shall be 27.0 feet ~nd width of the
aisles between compact sized st~lls shall be 19.0 feet.
2. Handicapped parking stalls shall be de-
s i.gned and located so that no 11and icapped person has to
go behind ott1er par-king stalls to reach the nearest
exit.

dential park inq off of Alma Street. shall be 1 im i ted to
right turn only.
4. Twenty-two (22) of the public parking
spaces sha.1l be made available for the project's resi··
dents for the hours of 5~00 PM t.o 8:00 AM weekdays and
all day on Saturdays, Sundays and Holidays. These
stalls shall be short term parking stalls for daytime
use and be located on the first lt~ve.l (main level) of
the pa.J::'king facility.
5. Dux-i ng the period of canst rue: don of the
parking structure, deve.loper shall provide temporary
public ?ark ing on another location reasonably close to
the project and acceptable to the City, or if an alter
nate location is not possible, pay to the the City
$2,960 per month for the period of time that. the public
parking in Parking Lot Q is not available.
\C) Im2rove~~
1 ~ All .improvements and development sha 1.1 be
s ubst.an t i ally in accordance with the approved develop
ment plans, wi.th all applicable codes and ordinances,
and with the requirements of the Director of Public
Works/Engineering, the Director of Utilities, and the
Chief of the Palo Alto Fire Department.
2. The Contractor shall schedule .~ coordina-
tion meeting with the developer and the City Public
Works, Building and Transportation staff for the purpose
of resolving construction details including excavation,
shoring~ use of public right-of-ways, and similar de
tails. No building or excavation permit shall be issued
until these details have been agreed to by the City.
3. The develope'~: shall include adequate pro
visions in the Covenantsr Conditions, and Restrictions
{CC&R 1 s) of the homeowners' association for the mainte
nance of the landscaping on the four residential
levels.
4. Prior· to the issuance of a building per
mit, the developer shall obtain approval and recordation
of a subdivision map dividing the pub.lic parking prop
erty from the private residential and pal:'king dev~lop
ment and subdividing the private "parcel" for condomin
iums~

5. Developer and City have entered into an
Option Agreement, dated April 14, 1981 (Contract No.
4 i 51) and shall enter. into a Conveyance Agreement. The
ag~eements govern the conveyance of the City's air
rights to the Developer. Developer shall perfor.m in
accordance with the applicable terms of those documents.
6. Prior: to '.:.he issu a nee of a building per
