The Council of the City of Palo Alto does ORDAIN as follows: SECTION 1. SECTION 2. Section 18.04.030(136) [Definitions] of the Palo Alto Municipal Coae is hereby amended to read: " ( i 36) 'Take-out servic~' means a characteris- tic of ~n eating or ul'.' inking service which encour­ ages 1. on a regular basis, consumption of food or beverages, such as prepared or prepackaged items, outside of a building, in outdoor seating areas where regular ·table service is not provided, in vehicles parked on the premises, o~ off-site." SECTION 3. Section 18.71.0SO~h) [OS District] is hereby added to the Palo Alto Municipal Code to read: " ( h) Accessory dwellings ~nd 91Jest <..'Ott.ages r when accessory to permitted residential use." SECTION 4. Section 18. 71.140(a) [OS District] of the PaJ.o Alto Municipal Code, is hereby amended by adding . ':le following paragraph at the end of the section: "This requirement may be waived by the city engineer for structureE> in Group M or.cupancy, ao defined in the Uniform Building Cod~, acces~Qry facilities and landscaping where: such improvements, in his opinion, would pose no potenti.:.l hazard to lite or property on thE subject or surr6unding properties." SECTION 5. Chapter 18. 83 of the Palo Al to Municipal Cod~ is hereby amended to read: .. • • Chapter 18.83 OFF-STREET PARXING AND LOADING REGULATIONS Se<.!tions: 18.83.010 18.83.020 18.83.030 18.83.040 18.83.050 18.83.060 18.83.070 18.83.080 Specific purpo&es. Applicability of regulations. Parking assessment districts. Schedule of off-street parking; loading bicycle facility requirements. Basic regulations. Design standards. Adjustments to requirements of schedule. Design standards, Tables. 18.83.010 Specific purposP-::a. Off-street pc.i:king, load.inq, and bicycle facilities are required for new uses and enlargements of existing uses, proper t ion al t.c the need created by each use, in order to alleviate t:raffic ·.:ongestion. Development regulations and design standards are in tended to ~msure the usefulness of parking, loading, and bicycle facilities, protect the public safety, and, where appro­ priate, to mitiqate pctontlal adverse impacts on adjacent land uses. 18.83.020 Applicability of regulations. The regulations of tnis chapte.i.'.' shall be applicable in each district established by this title. 1e.33. 030 Parking assessment districto. In any parking as- sessment district established by the city for the pur.pose of providing off-street parking tacilities, all or a 1?0rtion of the off-street park­ ing requirement for a use may be satisfied by payment of assessments or· fees levied by such district on the basis of parkinq spaces required but not provided. 18. 83. 040 Schedule of off-street parking, loading and bicycle facility requireaents. (a} The schedule of off .,.street. parking, loading and bicycle facility requirements established by subsection (b) sha.11 be appli..::{1 as follows: (1) Where the application of the schedule results in a frac­ t i~nal requb:ement, a .fr act ion of O. 5 or 1:3reater shall be resolved to the hiqher whole number. ( 2} For purpose'S of this chapte:e, ~;tro~s floor area shall not include enclosed or covered areas used for off-street parking or load~ ing, or bicycle facilities. (3) Wr~re uses or activities subject to differing require­ ments are locatci.. in the same structure or on the same site, Cl'.' are j ntended to be served by a common facility in accord with S~ction 18.83.070, the total requirement shall be the sum of the requirements for each une or activity computed separately, except as provided by Section 18.83.080. (4) Where requirements are established on the basj.s of seats or person i::apac i ty, the bui .ld ing regulations prov is ions applicable at the time of determination shall be used to define capacity. (5) Where residential use is conducted together with or accessory to other permitted uses, applicable residential requirements shall apply in addition to other nonresidential requirements, except as provid-ed by Sectivu 18.83.070. (b) In each district, off-street parking, loading and bicycle facilities for eaclt use shall be provided in accord with this chapter. (b) No use of land lawfully existing on the effective date of this section is nonconforming solely because of the :ack of off-street parking, loading, or bicycle facilities prescribed in this chapter1 provided, that facilities being used for off-street parking on July 20, 19 78 / sha 11 not be reduced in capac;. ty tv less than the number of spaces prescribed in this chapter or altered in design or function to less tha, the minimum standards prescribed in ttis chapter. (f) Parking, loading and bicycle facilities required by this chapter shall be maintained for the duration of the use cequiring such facilities except as authorized pursuant to Section 18.83.070. (g) All off-street parking facilities required by this chapter shall be loc~ted on the same site as the use for which such facilities are requi~ed, except as authorized pursuant to Section 18.83.070~ (h) No use shall be required to provide more spaces than pre- scribed by this chapter, or prescribed by the director of planning and community environment in accord wit:. this chapte,r or prescribed by any conditional use permit, var.iance, or planned community district. Where additional spaces are provided, such spaces may be con~idere:d as meet­ ing the requirement for another use, subject to Section 18.83.070. 18.8J~060 Design st~ndards. (a) Design stand~rds are established by this section ~o set basic dimension and guidelines for parking, bicycle, and loading facilities. Such standards shall he used by the building official, the director of planning and community environment, the zoninq administrator, the plan­ ning commission, the architectural review boarJ, and any other authori­ ties, departm~~nts, boards, or commissions responsible for application and administration of parking and loading regulations established by this chapter. ( b} Parking and Load i.ng Space :>imens ions. '!'he fol :i..owing basic dimensions shall be observed for parking and loading spaces with park­ ing angles of ninety degrees. ( i''or all otner parking space atandards, refer to parking dimension tables.) All parking spaces should have a ,:..·t!·=~l clearance of not less than 2. 3 meters ( 7. 5 feet). 3. • • (1) Each standard size off-street parklng space shall consist of a rectangular area not less than 2.6 meters (8.5 feet) wide by 5.5 meters ( 18 feet) lonq. ( 2.) Each sm~ll car off-street parking space shall be not less than 2.3 meters (7.5 feet) wide by 4.9 meters (16 feet) lonq. Purpose and Descrip~ioE_ For long-term parking: Protects aqainst theft of entire bicycJe and of its components and accessories. Lockers~ check-in f~cilities, monitored park1~, and res.tr:icted access parking areas are some, but not the only, exam­ ples of this level of security. Tne facility must also protect the bike from inclement weather, including wind­ dri ven .:.ain. Definitions: -A locker consists of a fully enclosed space accessible only to the owner or operator of the bicycle. This space m~y also serve other purposes. -In a check-in parking system, the bi­ cycle is aeT"ivered to and left with attendant ( s) with provision for iden­ tify L\g the bicycle'..:; owner. Other facilities not listed above but providing an equivalent level of secur­ ity must be approved by the Di rec tor of Planning ar.d Community Environment. For short-term parking: A stationary object tu which the user. can lock the frame and both whee 1 s with user-prov5.de<~ lock. On one side of each bicycle this clear·ance shall be at least 24 inches ( iO ~ 60 metflr), and shall allow the user to lock the bicycle to the facility. This acc~ss gpace may be shared by adjacent bicycles. Where the design per­ mits, the access clearanc~ should be increased ~o 30 inches (0.75 meter). (3) An aisle or other space s~;all be provided to bicycles to enter and leave the facility. This aisle shall haVP. a wi.dth of at least 5 Ieet ( I • 5 meters) to the front or the rear of a standard 6 foot ( 1. 8 roet(!:t's) bicycle parked in the facility. (4) Parking facilities shall support bicycles in a stable position without damage to wheels, frame, or c:omponents. (5) Bicycle parking should be situated at least as c-:".>r;veniently as the most convenient car }:Jark­ ing area. Eicycle and auto parking areas sha 11 be ::.epara ted by a physical bat·r ier or sufficient distance to protect parked bicycles from damage by ~ars. (6) Paving is not required, but the outside ground surfrace shall be finished or planted in a way that avoids mud and dust. (7) Class 2 and Class 3 facilities should be loceited in highly visible arDas to minimize theft and vandalism. 5. • • (8} Where bicycle parking areas are not clearly visible to approaching bicyclists, signs should indicat~the locations of the facilities. ( 9) Where Class 1 parking required by this ordi­ nance is provided by Restricted Access Park.­ i ng, a sign shall be posted at the entrance to the parking area stating that the bike enclo­ sure shall be kept locked at all times. (10) The Dire<:tor of Planning and Community envi­ ronment shall have the autho~ity to review the des i g n o f a l l b i c y c 1 e pa r )~ i n g f a c i 1 i t i es re - quired by this ordinance with respect to safety, security, and convenience. (d) Parking Facility Landscaping. shall be observed: The following basicstandards (1) Each unenclosed parking facility shall. provide a minimum of interior landscaping in accord with the followinq t.:ible. The perimeter landscaped strip may include any land­ scaped yard or. landscaped area otherwise req.dred, and shall be contin­ uous, except for required accesG to the 5ite or to the parking facil­ ity. Where the landscaped strip adjoins a public street o~ pedestrian walkway, the landscaped strip may be required to in~lude a fence, wall, berm, ot· equivalent fe"3.ture. Where the paeking facility adjoins an­ other site, a fence, wall, or other equiv~lent screening featui:e may be required. ( 3) Trees in reasonable number shall be provided. Ground cover alone is not acceptable. Where screening is desirable, a combi­ nation of trees and shrubs shall be used. Interior landscaping shall be distributed throughou·.: the paved area as evenly as possible. (4) Prevision shall be made for automatically irrigating all planted area. (5) All landscaping shall b€! protected with concrete curbs or other acceptable barriers. (6) All landscaping shall be continuously ma\ntair1ed. ( 7) The landscaping standards .set forth above shall not ~pply to temporary parking facili~es; howAver, the Architectu~~l Review Board, through its review, may require minimum landscaping for such facilities. 6. • • ( e ) Park in g F :.. c l l i t y Des i g n • Bas i c q u id e 1 i n es f o c pa r k i n g 1 o t dimensions and access driveway dimensions and underqround parking facilities are shown in the tables accompanying this section. Addi­ tional quidelines for parking facility design, internal layout, accept­ able turning radii and pavement slope, vehicular and pedestrian circulation, and other design features may be adopted by the di rector of planning and community environment when deemed appropriate. The director of transportation may require cross-aisles within parking f ac i 1 it ies where necessary to prevent safety hazards and vehicular congest ion on public streets which miaht be created by vehicles ut i 1 i z­ ing public &treets to travel between aisli:=s or from one section of the parking facility to another. { f) Paving and Drainage. observed: The following basic standards shall be {1) In all di:stricts except the OS and AC districts, parking and loading facilities shall ~ surfaced '-md maintained wi~h asphaltic, concrete, o:r other permanent, imper:v io:..is surfacing mater i a 1 sufficient to prevent mud, dust, loose material, and other nuisances. ( g) Safety ;:.;:atures. the following standards: Parking and loading fncilities shall meet ( 1) Safety barriers,. protective bumpers or curo1ng, ano di­ rectional markers shall be provided to assure safet'./1 efficient utili­ zation, protection to landscaping, and to prevent ~:icroachment onto adjoining publ.ic or private property. {2) Visibility of and hetwe~n pedestrians, bicyclists, and motorists shall be assured when entering individual parking spaces, when .~irculating within a parking facility, and whc-; entering and exit­ ing a parking facility. ( 3) Internal circulation pat terns, and the lo cat ion and traf­ fic direction of all access drives shall be desig~ed and ~ainta:ned in accord with accepted principles of traffic engineering and tcaf.fic safety. (h) Liqhting. Lights provided to illuminate any parking facility or paved area shall, to the maximum extent feasible, be desi~-·ed to reflect away from any residential use. (i) Noise. Areas used for primary circulation, for f~~quent idl­ ing of vehicle ?nqines, or for loading activities shall be designed and located to minimize impacts on adjoining properties, including provi­ sions for screening or sound baffling. (j) Maintenance. All parking and load1ng facilities shall be maintained to assure desirability and usefulness of the facility. Such facilities shall be maintained free of refuse, debris, or other accumu­ lated matter and shall at all times be availajle for the intended off­ street parking or loa(Hng use for which they are required or intanded. ( k) Application of Design Standards to Other :?aved Areas. The standards of this section shall apply to all paved areas used for out­ door display, storage, sai'?-s, or other purposes associcited with permit­ ted and conditional office, commercial, or industrial uses. 7. • • 18.83.070 Adjustments to requirements of schedule. Automobile and bicycle parking requirements prescribed by Section 18.83.060 may be adjusted by the director of planning and community environment in the following instances and in accord with the prescribed limitations, when in his opinion such adjustment wi 11 be Li accord "'i th the purposes of this chapter and will not create undue impact on existinq or potential uses adjoining the site or in the general vicinity. (a) Substitution of Bicycle Facilities for Required Vehicle Facilities. Eight class 1 bi~ycle parking facility spaces in addition to min imurn bicycle require men ts may be subst.i tu ted for one requ .i r:ed vehicle parking space, up to a maximum of five percent of the vehicle spaces required. (b) Joint Use P~rking Facilities. For any site with multiple uses, or for adj oi ni ng sites, where the application of this chapter requires a total of thirty or more spaces, the total number of ~!")aces initially requir-ed by application o.i: the sched11le may be reduced by not more than twenty percent where in the judg;nent of the dir-ector d: plan­ ning and community e. 1.1ironment the joint facility will se>:ve all exist­ ing, proposed, a.nd potential uses as effect:.ively and con\•eniently as would separate parking facilities for each use or site. Notice of any adj:;..:itment made pursuant to this subsection shall be given in accord with the pr0v1sions of Chapter 18.93, l:,ny ,::.igqrieved or affected person may appeal an adjustment made pursuant to this subs~c­ t ion in accord with the provisions of Chapter 18. 9 3. Unless such an appeal is filed within the time specified therefor, the decision of the director of planning and community environment shall become final upon the expiration of said time p~riod. ( c) Housing for the Elderly. The t.otal number of spaces requi1::-ed may be red11c,~d by not more than fifty ; ?rcent, whr:~~ in the judgment. of the di rector of plann.ing and cornmun i ty environment, such reduct ion wi 11 be commensurate with the reduced parking demand created by the housing facility, including visitors and accessory facilities. Not ice of any adj ustrnent made pursuant to th is subsection .5hal 1 be given in accord with the provisions of Chapter 18.93. Any agqrieved or affected person may appeal an adjustment made pursuant to this subsec­ tion in accord with the provisions of Chapter 18.93. Unless such an appeal is filed within the time specified therefor, the decision of the director of planning and community environment shall become final upon the ,~xpiration of said time period. (d) Deferral of Meeting Full Requirement. Where the expected need for of.C-street parking for a particular use is uncertain, due to unknown or unusual operating charac ... eristics of the use and una\<.::tila­ bility of cumparable data ~,'J establish need, the building official, upon recommendation of the archi tectur.al review board, may authorize that construction and provision of not more than fifty percent of the required spaces be deferred, and may set such oond it ions as necessary to guarantee provision of such deferred spaces whenever the building official determin~s the need to exist~ Land area required for provi­ sion of deferred parking spaces shall be maintained in reserve and s~all be landscaped pursuant to a plan approved by the architectural review board demonstratin..,; that ultimate provision of the deferred spaces will meet all requireinents of this chapter. (e) Transportation and Parking Alternatives. Upon demonstration to the director of planning and community environment that effective alternatives to automobile access are in effect, the director of plan­ ning and community environment may defer· .by not more than twenty per­ cent the parking requirement otherwise prescribed for any use, or com­ bination of uses on th~ same or adjoining sites, to an extent oommen­ surate with the permanence, effecliveness, an<l the demonstrated reduc­ tion in off-street paJ:"king demand effectuated by such al tei:nati ve pro­ grams. 8. • • Land area required for provision of deferted parking spaces shall be maintained in reserve and shall be landscaped p rsuant to a plan approved by the architectural review board demonstrating that ultimate provision of the def erred spaces wi 11 r.:~1:::1.. al 1 require men ts of this chapter. The director of planning and community environment shall set such conditions a::; necessary to guarantee provision of such deferred spaces whenever the building official determines the need to exist. Alternative programs which may be considered by the rHrector of planning and community environment under this provision include, but a:..:.:: oot 1 imi ted to the following~ ( 1) Immediate proximity to public transportation facilities serving a significant proportion of residents, employees, and/or cus · tomers; (2) Operation of effective private or company ca:r pool, van pool, bus, or similar transportation programs~ ( 3) Evidence that a proportion of n~sidents, employees, and/ or customers utilize, on a regula~ basis, bicycle transportation alter­ natives commensurate with reduced parking requirements. ( f) The director of planning .:md community environment may au th~ orize all or a portion of the requlred parking for a use to be located on a site not more than 152.4 meters (five hundred feet) from the site of the use for which such parking is re<.f'.L.edr whei::e in his judqm~1t such authorization will be in accord with the purposes of this ~hapter. The director of planning and community environment shall require such covenants and guarantees as deemed necessai·y to ensure use and mainten­ ance of such parking f~cilities. 18.83.080 Design standards, Tables. Dimensions for P~rallel Parking Spaces "The parallel parking space dimensions for standard-size cars shall be a minimum of .3 .O meters { 10 re~t) wide and 7. 3 met.e'CS { 24 feet} long. The parallel parking space dimensions for smi:lll {compact) size cars shall. b~ 3.0 meters (10 feet) wide and 6.1 meters (20 feet) long. The P-nd parking space for either size of car may be only 6. 1 meters ( 20 feet) long.
