ORDINANCE OF THE COUNCIL OF THE CITY OF PALO ALTO
AMENDING CHAP'rER 2 2. 08 \PARK DEDIC,~T10NS) OF THE
PAI,O ?.LTO MUNICIPAL CODE :.J'i ADDING SECTim;
22.08.330 (ARASTRA PROPEk'i''i)
WHEREAS, the City of Palo Alto in 1976 acquir~d 514.053 acres of
land known as the Arastra Property as described on Exhibit A-21.g(a);
and
WHERE AS , the city of P a lo A 1 to des i res to d ed i cat e 4 3 1. 0 8 4 o !:
said 514.053 acres and 1.697 acres of other adjacent City p:-operty
for park, playground, recreation and/or t:onservat ion purpos~s, while
retaining 77.219 acres for possible development to, among other
things, recapture its initial investment; and
WHEREAS, consistent with the cluslering principle of Palo Alto
Municipal Code Chapter 18.71 and Palo Alto Resolution No. 52S1J, the
City of Palo Alto desires to trC'nsfer the den~3ity or de'V'elopment
cap~~ity of said 514.053 acres to the 77.219 acre parcel;
HOW, THER8FOREr the Council of th0 City of Palo Alto does ORDAIN
as follows:
SEC·riON 1. Section 22.08.3.10 hereby is added to the Palo Alto
Municipal Code to re~d as follows:
•22.08.330 Arastra Property. A. That
certain parce 1 s of 1 and known as the Arast ra
Property as delineated and described in Exhibit
A-21.9(b) attached hereto are hereby reserved for
park, playground, recrPat ion and/or conseL·va t ion
purposes provided that the dedicated 0.956 acy:-e
parcel described on Exhibit A-21.9(d) may be tem
porarily used for non park purposes for a period
of one year from the effective date of this ordi
nance, which period may be extended by one year
renewals adopted by resolution of the City Coun
cil, but in no event shall such renewals cf non
park use continue beyond five years from the ef
fective date of this ordinance.
"B. Consistent with the clustering princi
ple of Palo Alto Municipal Code Chapter 18.71 and
Resolution No. 5293, the development or density
capacity of the 514.053 acres of land des~ribed
in Exhibit A-21.~(a~, determined to be 51 lots
pursuant to Palo Alto Municipal Code Section
18.71.070i is hereby transferred to that certain
77.219 acre ~arcel of land as delineated and de
scribed in El<:hibit A-21.9 (c). Nothing herein
requires that said parcel described in Exhibit
A-21.9(c) be developed to its maximum density of
51 lots, or be dev~1oped in any manner whatso
ever. In the event tha.t this subsection B is
de~ermined to be in~alid by a court of law, the
o e d i cat ion of the parcels described in Exhibit
A.-21 .9 (b) of subsection A above sha 11 become null
and vcid."
SECTION 2. All provisions of Chapter 22.08 of the Palo Alto
Municipal Code shall apply to Section 22.08.330 with the same force
and effect as though said section were originally includeo therein.
SECTION 3. The Council finds that thi~ project is categorically
exempt from the requirements of the California Environmental Quality
Act and does not require an environmental assessment.
