We are concerned about the lack of action by the city of Palo Alto in issuing our project for permit. We have been waiting for final comments and to date nothing has been released regarding our latest submission. This process has been going back and forth for a ½ year. Morgan Stanley has been a long term tenant in this market, and we are starting to be concerned by the lack of resolve for a simple Tenant Improvement application. The application is going on 6+ months. While I understand the challenges in general with Building Departments and COVID, this is excessive and exhausting. We are spending tremendous amount of money for extended schedules and coordination, resubmissions and what appears to be endless comments. I am often reminded that extended reviews are common for the City of Palo Alto from other industry peers and contractors. But why 6+ months? Can you kindly review this project and advise on when and where the last comments are? We see from your portal that there is another round of comments- but these were not released by 1/13 as was planned for. We have gone through so many rounds of reviews, delaying trades, furniture, and BU operations as a result of these delays. No business can wait this long for a building permit. Us like you have a responsibility to deliver for our employees and clients. We currently are not able to do this or provide any sort of reassurance that this project can be completed in the near future. We are very disappointed with this progress and with the unforseen financial & operational impacts of these delayed review comments. We hired a national Architect- Stantec with an exceptional track record in the Bay Area and beyond to ensure we provided the best possible plans and specs to your agency & our stakeholders. It would be an extraordinary addition to Palo Alto’s Urban Forestry program for Heritage Trees. I have included a report from one of Palo Alto’s finest arborists, David Dockter, and several pictures of the tree, including a painting of the tree by my granddaughter, Bryn Barton. When I moved into my Forest Court home in 1977, the yard was barren, except for two badly trimmed and topped eucalyptus trees and one desperate oak in the middle of the yard. This was also the year we had one of our unusually rainy storms and during the night the poor oak just fell over taking out part of the fence, leaving my house intact. After the cleanup, I consulted with my friend Mary Gordon, Landscape Architect, and she recommended planting the African Linden and the Coast Redwood. I have kept the African Linden (which was from a pot at my former house) well in check and the Redwood was allowed to grow at will, with regular watering. Today this wonderful tree is over 65 inches in diameter and 163 feet in height. I think it is magnificent. It belongs on Palo Alto’s list of significant trees – El Palo Alto’s neighbor! One of Palo Alto’s most beloved assets is its trees. It is quite wonderful to drive (or walk) down our streets and marvel at the great variety and number of trees. It was always my aim when I was on the council that any development that proposed taking out a tree was obligated to plant a replacement. It was most painful when developments replaced trees with what I called “buggy-whip saplings” which usually took another 20 years to grow to 20 feet tall, if they even survived that long. I compliment you on your recently revised tree ordinance; you recognized Palo Alto’s great tree value. If you read David Dockter’s assessment of my proposed designated heritage tree I think you will appreciate my desire to protect this tree for future Palo Altans. I understand you are proposing the tree be considered for a City of Palo Alto Urban Forestry program for Heritage Trees, a formal Resolution by City Council for designated trees that meet certain qualifications1. This report is prepared for the purpose of providing both you and City Council with an overview of the tree's size, health, history, and value to the community to aid their consideration of the tree to be designated. The City of Palo Alto Heritage Tree designation would be in addition to its existing status of a protected tree pursuant to the Tree Preservation and Management Regulations, Palo Alto Municipal Code, Chapter 8.10. I am a qualified arborist certified by the International Society of Arboriculture 2. Because of the considerations and findings documented below, I believe that the Heritage Tree candidate Coast redwood is unique and of importance to the community because it is a desirable species, healthy, sizable, and is perhaps one of the best examples of a Coast redwood in the city. LOCATION OF THE TREE The tree is located on your property at 1019 Forest Court, Palo Alto, California. It is well-placed in the northwest rear yard corner within the side and rear setback area, safely distant from primary structures in all directions. A typical good-neighbor wood fence to the north is approximately two feet clear from the tree base and a wrought iron view fence is located near the base on the west side. The dominant tree is standing compatible among several understory shrubs and trees sharing its environs, including a rare African Linden (Sparrmannia Africana) and Argyle Apple (Eucalyptus cineria). SPECIES, HABITAT, SIZE AND AGE OF THE TREE The subject tree, a Sequoia sempervirens ‘Los Altos’, Coast redwood is native to California and indigenous to the foothills of the Santa Cruz Mountains. The variety, ‘Los Altos’, is propagated from an original parent tree of the Los Altos foothill region adjacent to Palo Alto. This is considered a beneficial asset and may well ensure this individual tree’s prognosis to be more adaptable and resilient to climate or other stresses than other varieties sold on the market and planted throughout California. The Coast redwood tree is 65-inches in diameter, 163- feet in height and has a lower crown dimension of 54-feet x 42-feet. I understand that you planted the young tree (3-yr. Its root growth has been opportunistic in the regional alkaline soil (proximity to San Francisquito Creek alluvial sediment) and water table, as well as incidental landscaping surface water from yards. My general observations indicate that the tree is:  a handsome upright tree visible from distant neighborhood streets  exceptional in structure, dark green foliage color and aesthetic beauty  supporting fair annual shoot growth (an average of six inches over the last 5 years)  well-rooted with little chance of toppling over  adapted nicely to the regional soil characteristics The exceptional tree structure and superior crown is evident from many years of professional maintenance practices from tree workers under your direction. Absent of many common deficiencies, the single upright stem has no side spar trunks or bifurcated top, only a minor basal flare, and branch lengths on the entire tree have been proportionally tipped for safety. This end-weight pruning of branch ends yields a minimal risk of branch failure and a strong structure able to withstand strong prevailing winds. Coast redwoods are resilient--not prone to many insects, disease, or fire. The tree needs no special attention other than pruning. CULTURAL AND FAMILY LEGACY SIGNIFICANCE You have reported to me that the Coast redwood tree has been lovingly recreated by your granddaughter, Ms. Bryn Barton, with a wonderful patio fresco mural painting executed on the outside wall of your home. The backyard wall painting, protected in an alcove from the elements by the roof eve overhang depicts the special Coast redwood tree among other natural elements envisioned by the artist. From the vantage of the family patio, viewing the painted wall fresco with its playfully designed tree theme, the onlooker can simply look up over the eves to see the actual living redwood tree towering over the roofline. A fresco painted on real property reinforces a relative permanence of the tree to the property and neighborhood. City Council may wish to consider this importance of the tree + fresco family legacy element when determining the Heritage Tree designation. In addition to the family legacy significance of the redwood, the tree species is in good company associated with the El Palo Alto Redwood 3, a local cultural resource and California State Historical Landmark #2. APPRAISAL AND TREE BENEFITS National, state, municipal and real estate recognize that plants have value beyond their aesthetic contribution to a landscape, and that their contribution can be assessed. The following horticultural appraisal, using the current Guide for Plant Appraisal authored by the Council of Tree and Landscape Appraisers and published by the International Society of Arboriculture, includes consideration of the tree species, size, condition, and location/tree placement factors that influence the value of a tree. Community-wide tree benefits can be understood and forecasted by using the National Tree Benefits Calculator using i-Tree. For approximate reference a 45-inch trunk size Coast redwood may provide the following annual benefits to the local community5 through cost-avoidance or accrued value:  A 45-inch Coast redwood will raise the property value by $405 this year and will add 387 sq. ft. of leaf surface area, increasing in subsequent years.  A 45-inch Coast redwood will conserve 525 Kilowatt hours of electricity for cooling and reduce consumption of oil or natural gas by 13 therm(s).  A 45-inch Coast redwood will intercept 5931 gallons of stormwater runoff this year, acting as a mini- reservoir controlling runoff at the source. CONCLUSION Supported by the above considerations and documented findings, I find that the Heritage Tree candidate Coast redwood is unique and of importance to the community and family heritage because is a desirable species, healthy, sizable, and is perhaps one of the best examples of a Coast redwood in the city. I support the City Council designation of the Coast redwood to be added to the Heritage Tree List on behalf of the property owner and the current and future residents of the City of Palo Alto. Hi Ms. Thiessen, The name of my roofing company was Meraz Roofing, Inc. (559) 275- 0640. Their office is at 2380 E. Dale Ave., Fresno, Ca. 93706. Hours are M-F 9AM-5PM. Mailing address is PO Box 9456 Fresno, Ca. 93792-9456 BBB says one complaint in 3 years, zero complaints in the past 12 months. In business for 18 years. I told Mr. Meraz in an email after the roof was on that his must be the best roofing company in California. He is the owner. They really are fantastic. They did the whole job in a week. Removing the old shake roof (which goes into a big dumpster they place on your driveway), prepping the existing plywood which was under the shakes, replacing one panel of plywood that had a small hole in it., putting on the new composite roof. Wow. They said they were re-roofing a school at that time and that they have done roofs in Beverly Hills and on the coast. One of his crew said that when they do that they all stay in a motel on the coast. BTW, you cannot sell a house with a shake roof now in California. He quoted me $7,900. There were a couple of smallish items in addition, replacing that one panel of plywood, replacing maybe 12 feet of boards that run right under the rain gutters at the edge of the roof (flashing?), filling in a small gap of stucco apparent when they removed the shakes from the garage roof, and he charged me an additional $250 for those items. Can you imagine? Some outfits would have charged $500 easy. So I paid a total of $8,150.00 and was VERY glad to get a new roof for that. One roofer had told me on the phone that it might cost $30,000. After I recovered, I called my friend Dennis Balakian and he referred me to Meraz Roofing. I should note that I was fortunate to have plywood under the old shake roof. The whole house had a plywood roof under the old shingles. Not everybody has that. My neighbor across the street said they didn't have it when they replaced their roof and plywood is expensive, especially right now. Having to install the plywood if you don't have it drives up the cost significantly. I asked someone what they do when they build a house if they don't install plywood first, and he said this: Imagine the rafters running up and down from the peak of the roof down to the edge of the roof. They nail strips maybe a foot wide running across the rafters from left to right with maybe a two foot gap between them. Then, since the shingles come in panels, they can nail those panels to those strips. No plywood that way. Note re payment: I thought I would give Mr. Meraz a personal check for $8,150 since I do not give people bad checks. He didn't come on a Wednesday to get it and he didn't come on Saturday. I finally figured out that a cashier's check is what he wanted, so I told him on Sunday that I would go to my bank and get one on Monday and mail it that day, which I did, certified mail. Check dated Monday, August 9, 2021. They got it on Wednesday and they called and said they got it. So a cashier's check is the way they want to be paid. They have gotten burned on personal checks apparently. Hope all of this helps. BTW my house was built in 1990, so it was 31 years old by 2021. I bought it in November, 2000 for $97,500. (Pre-war, 3 bed, one-bath houses in Santa Clara were $450,000 at that point). The new roof was installed in July, 2021. The company that makes the shingles (in the USA) mails you a warranty. I think Meraz gives a warranty too. Also BTW, something to know: When they nail the shingles to the plywood, each nail their nail-gun drives in creates a little chip of plywood which falls in. Michael Short/Special to The Chronicle 2019 To much of the rest of the country, California is the most progressive state in the union. To the Working Families Party, it isn’t as progressive as it could be — and that’s why the national organization has launched a California branch and will announce former San Francisco Supervisor Jane Kim as its executive director Thursday, The Chronicle has learned. Instead, this year it is planning to introduce itself to voters by focusing on a handful of legislative races, even if that means taking on more moderate Democrats in the hope of pulling the larger party further to the left — particularly on health care, criminal justice reform and wealth inequality. With roughly half of the Legislature due to be termed out in the next two years, party organizers want to take advantage of this transitory moment to change state politics. Democrats control all statewide offices and hold a supermajority in the Legislature. It has already started endorsing office-seekers, including Jennifer Esteen in Alameda County’s 20th Assembly District. It also plans to support San Francisco District Attorney Chesa Boudin as he fights the recall campaign against him. “A party isn’t a ballot line,” said Kim, who was the California political director for Vermont Sen. Bernie Sanders’ 2020 presidential campaign. “It’s a political home for people that share a common ideology, platform and commitment to making change through elections.” Kim thinks a lot of working-class Californians don’t feel totally at home in the Democratic Party. Organizers believe there is a market for their voice in a state where Sanders soundly defeated Joe Biden in the 2020 primary. Too often, Kim said, California Democrats listen more to wealthy donors and powerful corporate interests than they do the multiracial working-class voters who form the backbone of the party. That is one reason, she said, why California does not have a single- payer health care system or a tax on the super wealthy, like the kind that Massachusetts Sen. Elizabeth Warren proposed during her presidential campaign. Legislation on both was written but didn’t even get a hearing in the Legislature last year. (On Tuesday, however, the Assembly Health Committee supported single-payer legislation written by Assembly Member Ash Kalra, D-San Jose.) Kim and Christina Livingston, a state officer in the Working Families Party, declined to name a “corporate” Democrat legislator whom the organization would be targeting this year. Instead, they pointed to the kind of progressive whom the party has endorsed, Assembly Member Alex Lee, D-San Jose, who backs a single-payer health plan. The party, through its seven regional chapters in California, will endorse and support candidates in local elections with the goal of building a bench of like-minded candidates. Organizers are building the party by tapping into the membership of more than 40 progressive community, labor and grassroots organizations who are affiliating with them. Among them are Courage California, AFSCME 3299, CHIRLA Action Fund and SEIU 1021. Instead, for now, the Working Families Party is hoping to appeal to voters frustrated with Democrats. The Working Families Party expects to have a seven-figure budget for the year, which is modest in a state where it costs millions to air TV advertising for a week in one of California’s major media markets. But competing monetarily isn’t the only challenge organizers face, said Thad Kousser, a professor of political science at UC San Diego. For starters, California’s top-two primary system — where the top two finishers, regardless of their party affiliation, advance to the general election — makes it hard for a third-party candidate to compete. And if a Working Families Party-blessed candidate were to make it into the general election, it would likely be at the expense of a Democrat. If that were to lead to a Republican winning the general election, some Democrats would try to taint the Working Families Party as “spoilers.” “In order for a third party to show strength, you have to weaken a (major) party by costing it elections,” Kousser said. The Democratic Party won’t move to the left unless it feels a threat. “That’s the dilemma a party like this faces,” he said. Still, Kousser said, given Sanders’ success in California, “there is a thirst for this type of governance. I am concerned that the 6% vacancy factor for non office uses is low by perhaps a factor of 3 and the 15.7% vacancy for office uses is also low. I ask the staff to do a survey of vacant properties in the city currently. My every day walk through downtown suggest much higher and enduring vacancies. Relative to competitiveness analyses, I want the staff to provide vacancy data in neighboring cities. I am concerned that with normal turnover of properties and the many shared facilities that the administrative costs for smaller properties will outweigh the revenue collection and support a flat fee. Policy I support exemptions for all small businesses at least under 10,000 square feet and possibly at the 20,000 exemption level in EPA. I support no tax on hotels of any size for a minimum of five years as they have been and are very hard hit by the pandemic. The pandemic has made it very difficult for many if not most small businesses and it will take time to recover and many may not recover. My read of the data provided from staff is that a large share of revenue comes from a relatively small number of large private businesses so a very empathetic exemption policy will have a relatively small effect on revenues while substantially reducing administrative costs. I support an annual escalation factor if easy to administer. Re administration, I remember the difficulties with the existing fee and want to make sure any new tax is easy to administer and get compliance. The original metrics for a business tax included equity and competitiveness analyses. I am interested in seeing these metrics addressed in the current round of analysis and engagement. We are writing to you about that very topic—the greater good in relation to Castilleja’s application for a new Conditional Use Permit (CUP). By definition, schools contribute to the greater good by educating children. In particular, Castilleja provides a particular benefit as the only nonsectarian 6-12 school for girls in the Bay Area. This isn’t the right setting for all girls, but for some it makes the difference in their lives at an important stage. Castilleja also contributes to the greater good as a leader in TDM. Businesses and organizations across Palo Alto should look to Castilleja for ways to reduce THEIR car trips by up to 31%. Rather than incorrectly attributing the traffic on Embarcadero to Castilleja, we should credit Castilleja with finding creative and effective solutions. No one else has done more to reduce their traffic impacts in Palo Alto. Excellent schools benefit everyone by providing a place for children to learn and grow, by fortifying property values, by outreach in the community. Castilleja does all of this and would even do more if the terms of the CUP allowed it. Most of all, if more students can attend in the high school (without adding more traffic) all of those benefits increase. With accountability built into the plan, the school will only be permitted to grow if traffic remains the same. This proposal is all about public benefits. Dear Mayor Burt, Vice-Mayor Kou, and City Council: I attended the Monday 1/10/22 City Council meeting at which the revised North Ventura Coordinated Area Plan (NVCAP) was discussed. I have the following comments on that discussion: 1) Overall, the revised plan still seems geared primarily to profit-generation, for years to come, by wealthy developers of luxury homes and high-end apartment units. I think that the plan needs to be geared more strongly toward creation of truly affordable housing, within a true neighborhood, that is better integrated with the existing, overall Ventura neighborhood. 2) NO OFFICES! We do not need new office buildings in Palo Alto; there is a surplus of them sitting empty all along El Camino and Park Blvd. Given current and anticipated conversions in employees' work practices to 100% remote or hybrid work, this surplus is likely to continue. I agree with speakers who urged conversion of existing office space at the site to affordable housing through amortization and other means. I agree with speakers who expressed the opinion that this was a historically opportune moment to make this conversion and that the City of Palo Alto should seize upon it. 3) I agree with the speaker Monday night who questioned the wisdom of including retail space in the plan. We already know that, notwithstanding impacts of the pandemic, retail space such as that being proposed -- sited adjacent to El Camino and Park Blvd -- struggles to survive. New retail space at those sites will continue to struggle for several reasons, including lack of foot traffic, and the fact that El Camino and Park Ave are swift traffic throughways that challenge drivers' ability to safely stop and park in front of the stores or turn out of traffic to seek neighborhood parking nearby. Moreover, the planned retail shops will be in competition with those on nearby California Avenue. Finally, they appear to be too small and underparked to attract essential local retail services that have been lost to Palo Alto neighborhoods over the past 20 years, such as hardware, garden supply, bakery, and stationary stores. Instead, they appear to be best sized for occupancy by -- nail salons? fitness clubs? tutoring services? Arguably, Palo Alto already has enough of these. 4) I also agree with speakers who noted the Ventura neighborhood "park starvation." Small decorative patches of green scattered among buildings and edging pedestrian paths do not qualify as true park space. The revised plan still falls well short of providing the four acres of park space per 1,000 residents that is called for in the City's Comprehensive Plan. I agree with those who suggest that the City consider purchase of sites to comprise adequately large, useable parkland space and that these be included in the plan. 5) Relatedly, I agree with speakers who noted the City's once-in-a-lifetime opportunity to implement plans to naturalize Matadero Creek. I hope that this will become and remain a key goal of the plan. 6) I am in agreement with speakers who urged retention of historically important buildings in the plan. Relatedly, I hope that planners will attempt to incorporate historical Northern Californian and Palo Alto-specific architectural and landscaping aesthetics into the plan. As currently visualized, the plan appears to call for creation of high-rise, high density, primarily flat concrete, glass, and steel complexes, representative of Anywhere, USA. Recent examples of this approach include the massive Mountain View development edging San Antonio Shopping Center and the entire Mission Bay region of San Francisco. I urge Council to require the plan to include use of architectural and landscaping design, features, and materials that are consistent with Palo Alto's Northern California heritage and compatible with the overall Ventura neighborhood. I appreciate your commitment and hard work devoted to solving the enormously complex and challenging NVCAP puzzle. I hope that your future puzzle-solving efforts will be Palo Alto resident-centric, and focused on achieving financially-accessible housing that is set in a livable neighborhood that is historically, architecturally, and socially integrated with the Ventura neighborhood as a whole. Dear Commissioners, Please accept my brief note thanks for the work you did last year in advancing the Castilleja School modernization project. The dated, academic building that has been in the neighborhood since the 1960s is long overdue for updating with a sustainable new building that truly suits the needs of a 21st century education. Your feedback to the school last year was helpful, and I want to thank the school for the beautiful design they’ve put forward in accordance with your direction, City Council guidance, and feedback from neighbors. While it’s been an excessively long process, it’s been productive, and all of us can benefit from a school that blends nicely into the neighborhood using sustainable building materials and drought resistant landscaping. The school has done an excellent job providing you with design options that will preserve more trees and improve quality of life in the neighborhood AND that take neighbors’ needs and concerns into account. It has been an eight-year-long process of the school compromising and revising their project. Why have they stayed in the game so long? They want to educate more girls. Simple. So they have come up with many options to make that happen. At the same time, I hear opposing voices who seem to be open to nothing at all. It becomes harder and harder to honor those perspectives when the school has spent years listening, adjusting, and making changes that just never seem to be enough. In any process, it is critical to listen to all viewpoints. There is a difference between being heard and consequently invoking all suggestions. I appreciate that considering opposing perspectives on this project may put you in a challenging position. However, sometimes leaders must make difficult choices. As leaders of Palo Alto, I trust you to make recommendations that will allow this project to move ahead. Supporting education–even single-sex education–should be a city-wide priority. City council requested this official third-party count on March 15, 2021, and it significantly changes the applicant's request for variance. Locating this report is very difficult, and its importance is thus diminished. However, it is exceedingly pertinent to any discussion of Castilleja's project's request for a variance. The PTC vote on the variance, on 11/4/2020, Packet Pg 28: Finding 1: doesn't mention that the school's increasing their own property site by 1.36 acres in 1992 expressly excludes them from using size as a basis for a variance, and Finding 2: doesn't mention allowed FAR (.30) at all, and gave only (we now know) inaccurate current FAR (.43) and proposed FAR (.42). In order for the PTC to make a reasonable analysis, they need to know all three: allowed FAR (.30), current FAR (.51) and proposed FAR (.48). Current existing GFA is 138,345SF, proposed new buildings is 128,687SF. Allowable GFA is 81,385SF. Buildings added in the last couple of decades that didn't go through the PTC or usual channels in the development process and didn't get recorded properly are now coming to light; the site is significantly over-built. The actual square footage being requested in excess of allowed FAR is 47,300SF. Currently, planning commissioners learn vaguely about the report in the 12/15/21 PTC staff report, Packet Pg 26, although it is not called by the same title in the two places where it is referenced, and can only be accessed by a link which leads to the ARB 12/2/2021 staff report. From there, one has to scroll down to ARB Packet Pg 18 and footnote 9, for a link to a report called "City's consultant report on existing gross floor area..". A. The first link below is the ARB page, and it is important because it shows the flow of the GFA from the Dudek report to the project's plans, by segregating out, in different columns, the existing, proposed demolished, and proposed retained/new buildings (Packet Pg. 19). This ARB page states that volumetrics came into code in 1993. Both buildings that are counted with volumetrics were built (re-built) after that date (arts building 1998, gym 2006), so that's not a basis for reducing the professional measurement. Secondly, please identify who made the measurements and calculations and when they were made. The report, as you've explained to me, was provided by Dudek, and then city staff reviewed and studied and vetted it. However, I only see Katherine Waugh's name on it, and I'm sure you hired a professional surveyor (or Dudek did). I did notice that the summary page A-1 (after page 8) transposes the Rhoades building's numbers and the Arillaga building's numbers. This direction was further refined on March 29th when Council directed staff and the PTC to review an underground parking garage alternative that allows a maximum of 50% of the required on -site parking to be below grade without counting against the project GFA. More information on this amendment will be included in the PTC staff report scheduled for December 8, 2021. 2. Re-Analyze Existing and Proposed Gross Floor Area. Leading up to the City Council’s March 8, 2021 public hearing, staff learned of a discrepancy in the size of one of the existing campus buildings; more GFA was attributed to an existing building than should have counted. Specifically, 7,000 square feet (SF) of exempt below grade floor area was incorrectly included in the total existing gross floor area count. However, the applicant had also undercounted existing gross floor area in another portion of the building reducing this discrepancy to 4,370 SF of gross floor area.8 Due to the confusion regarding floor area, the City Council directed staff to prepare an independent (third party) analysis of the project site’s existing and proposed building areas, including basement space. Staff engaged a subconsultant to the City’s environmental consultant to prepare this analysis. The consultant report9 and findings are available online (link below). This analysis was prepared using a laser measurement tool and provides a greater level of precision than previously existed. Some assumptions were made regarding wall thickness, but in general, the results are the best possible calculation of existing floor area. This data was then evaluated to the existing code , which defines floor area that is included and excluded from GFA calculations, including volumetric spaces exceeding 17 feet and 26 feet in height. A 1993 code change for GFA required double and triple counting of this volumetric floor area , also known as second and third floor level equivalences, toward GFA. This was intended to recognize the impact of these spaces on overall building mass. It is clear these volumetric requirements were not considered in previous campus renovations and are not reflected in the applicant’s architectural plans. Existing Campus Gross Floor Area The applicant’s most recent project plans show an existing campus gross floor area (GFA) calculation of 109,297 square feet (SF), which is down from 116,297 SF previously presented to Council. This reduction accounts for corrected discrepancies and applicant- initiated floor plan adjustments. Accordingly, Castilleja’s total existing campus GFA, based on current code definitions and using enhanced measurement techniques, is 138,345 SF. Staff’s evaluation of the consultant’s analysis and the applicant’s project plans concludes that the discrepancy between the two data sets is mostly due to the omission of the volumetric floor area. The balance of the discrepancy is assigned to the applicant’s use of decades old permit records to report the existing GFA. This was a less precise way to measure GFA than the readings provided by the laser measurement tool to determine existing built conditions. Around the same time last year, more than 20 robberies and attacks swept the neighborhood, crippling businesses that were already struggling with financial losses amid the pandemic. “We're asking the victim and the family to come forward, and to report it to the police department ASAP,” said Carl Chan, president of the Oakland Chinatown Chamber of Commerce, according to NBC Bay Area. As a longtime Palo Alto resident, I have seen many changes over the years, some better than others, and I am writing to ask you to support one I feel could greatly benefit our community—the proposal to modernize Castilleja’s campus and allow the school to enroll more students without adding traffic. Castilleja School has been an institution in this city longer than any of us have been alive. Along with the many advantages that are brought by such an established and nationally well-respected school in our city comes the inevitable need for change over time. Castilleja’s plan to modernize their campus and gradually admit more students would allow them to adapt to the changing nature of our community. The Palo Alto we know today is not the same town as it was 10 years ago, or 20 years ago, or 60 years ago (even though that is the age of many of Castilleja’s current buildings). We should encourage and support schools like Castilleja to reflect those changes. The other schools in Palo Alto have been allowed to update and grow with time; why not Castilleja? Castilleja’s modernization plan is truly a win-win for the community and the school. They have shown their commitment to reducing traffic for years, including by increasing the number of buses during the pandemic when students no longer felt comfortable taking the Caltrain. As they can only enroll new students if they keep the traffic counts level with current numbers, we can have faith that we will not see an increase in traffic. I truly hope you will recommend this project for approval so that more students from different backgrounds will have the opportunity to access the only secular all-girls school in the Bay Area. Castilleja is presenting you with a meaningful set of compromises that will improve the neighborhood and strengthen our city, and I think it’s time we listen. And, per the 21 April 2021 staff report, we have already been contributing our tax dollars, and a portion of our utilities bills, to this project since 2003. Why should we pay even more money, for something from which we will draw zero benefit? 1a) I say this in the first context, that we were promised our utilities would be undergrounded, when we moved back to Palo Alto in 1996. Subsequently, wealthier neighborhoods received the substantial value of having their utilities undergrounded; but eventually, CPAU abandoned the effort altogether. So, our monies paid for a benefit for others, which we will never realize. It can be argued, that this juxtaposition with the FTTH project is a non sequitur. And, from the standpoint of symbolic logic, that argument is accurate. But from an emotional standpoint, from a personal standpoint, the argument is fair: every day I look out our windows and see the utility pole in our backyard, and the myriad of wires transiting to and from it. It's ugly. It's necessary. Why did some residents have a choice, to have *both* their utility needs, and their esthetic wants, met; while others did not? Given that reality, with respect to FTTH we appear, to me, to be poised at the same juncture, where the City creates winners and losers, rather than meeting the needs of all, fairly and squarely, efficiently and transparently. 1b) Let me re-phrase 1a) in a more positive manner. What would be the incremental cost, at the margin, to use the FTTH project as a springboard to bury all electricity and communications utilities? The 21 April 2021 report shows the incremental costs per foot of buried conduit(s), as a function of number of conduit, and diameter of conduit. It can't be very expensive to extend this analysis to include consideration of undergrounding *all* electrical-based utilities. And let me verify, I would be very willing to pay substantial money, to get this undergrounding done, without the expectation that the costs be shared by *every* ratepayer or resident. 1c) I say this in the second context, that the City *already* had a non-profit entity in place, called Palo Alto Cable Co-op, ca. 1996-97. The City, in what can only be described as a massive blunder, sold this non-profit enterprise. In return, the City reaped several 'benefits', which again serve a nearly-vanishing-fraction of Palo Alto residents. Against this context, I ask: what assurance do taxpayers and ratepayers have THIS TIME, that Council will not, in the future, make the same massive mistake? "Fool me once, shame on you; fool me twice, shame on me," is the rubric which applies. 2) If this FTTH project proceeds to fruition, what specific benefit will I, speaking selfishly for a moment, accrue? At present, we pay AT&T $49.99/month for 300+ Mbps service. This service is more than sufficient for our internet information and streaming and tele-conferencing needs. If FTTH goes to completion, will our rates go up, to pay for the additional capital costs and ongoing maintenance costs, city-wide, outlined in the 21 April 2021 report? Or, will our costs remain constant, but our speeds go up? Or, will our costs go *down*, because the for-profit utilities have more customers, among whom to amortize their operational costs? 3) Given that the City has been invested in this process since 2003, how much money has each ratepayer, and each taxpayer, already spent upon this project? 4) Why is the City investing in this at all? Why do we think we can do better than private enterprise? Why not simply create incentives for AT&T and Comcast and Sonic to extend their existing networks to cover the entire City; and, then provide subsidies to households whose incomes fall short of the threshold necessary to pay for high-speed service, so that *all* are served equally, at the price they can afford (which may be free, for some houselholds; and I'm OK with that outcome; I'd rather a portion of my communications and utilities bills go to a subsidy such as that, than bury the costs in some third-party, expensive analysis, which given the City's track record will only be re-done five years hence, with no substantive outcome). The efficiency and excellent training behind the actions of the crew were on display. Immediate assessment of the emergency, deployment of diagnostic equipment, appropriate questioning and calm assurances and demeanor were expressed. The episode ended well, and our family, calmed, reassured and with thorough follow-up directions chose to go home, comforted and taken care of. In particular, the lead attending paramedic (?) on that call, Matt Ferguson, deserves special recognition. Throughout the entire episode and process he was calm, informative, directing the operation with assurance while supervising the team and answering our family’s anxious questions as well as asking clearly appropriate diagnostically critical questions of the group. He managed all the avalanche of input with courtesy yet authority of expertise while doing what he needed to do. The balance of the 911 crew were also standing by the entire time, some assisting, others at the ready, again a sign of well trained and coordinated team. Please act and pass on, as most appropriate, my and my wife's sincere appreciation for the 911 response of that evening. Palo Alto always meets its housing goals for at-market or above market rate housing, but always falls short of meeting affordable housing goals. North Ventura provides a real opportunity to solve our below-market housing needs. The city council is going to be looking at yet another proposal for the Fry’ssite – something that has been studied by the NVCAP based on the multiyearwork of The Working Group. It appears the city staff keeps coming back withrecommendations/proposals that totally ignore the requests from the CityCouncil over the last few years. The question one is forced to ask is the following: Who does the City Staffwork for? Or alternatively, one wonders if the City Staff expects/wants theCity Council to rubber stamp their recommendations? By ignoring thedirectives from the City Council, it makes the presence of the City Council (anelected body representing the residents of this town) irrelevant! Is this reallywhat the City Council wants? It is definitely not what the residents expect ofthe City Council. With these important points raised, I would like to please listen once more tothe concerns of a number of the residents, especially from the VenturaNeighborhood. 1. Truly affordable housing is what the area needs: The latest plan, proposes 528 market rate units with the addition of 73 “ affordable “ housingunits . Unfortunately even those “ affordable “ units would expect applicants toearn at least $136, 150 annually to qualify for this housing. Given half thefamilies in the county make less, the so called “ affordable “ housing unitswould be out of reach for these residents who include, graduate students,teachers, day care employees, healthcare and retail employees, retirees andothers who need to have places to live that are within their reach. 2. Is the city Staff pushing to hand Big Bonuses to wealthyDevelopers of Top-Rent High-Rises? Bonuses that are being proposed by the city staff include extra height, smallerand denser units, fewer parking spaces than necessary, with no green spaceround buildings, as well as allowing more massive buildings, a feature notfound anywhere else in residential neighborhoods in Palo Alto. This give awayonly enriches the wealthy land owners offering such white elephants as the$4545 monthly rent for a 522 sq.ft one bedroom apartment in the new buildingat 2755 El Camino Real, which by the way was the recipient of many of thesaid city bonuses . One might ask, what happened to the City Council’srequest to come up with proposals that address affordability at the low endof the earnings curve? This question in turn should strongly suggest to the City Council that they “ should be offering bonuses only to projectsproviding 100% truly affordable housing “ 3. City Council’s request to the City Staff to phasing out offices in NorthVentura to free up land for parks and homes ! What has happened to thisrequest? The response has ben that owners of office buildings will notvoluntarily comply and are not interested in reducing their R&D/Officepresence for the benefit to the community. If this is their stated position, the question one is forced to ask is “ Why is it in the interest of the residentsof this town and who are represented by their City Council, togrant bonuses to the developers to grant concessions and bonuses inregards to parking, height limits, density, inconveniencing the residents of North Ventura? “. There needs to be a decreefrom the City Council requiring the offices to be shutdown, with out which North Ventura will forever besaturated with offices and employee cars and the increasedtraffic – instead of being like any other resident-oriented neighborhood in Palo Alto. 4. The question of providing adequate parks for the area has been a longneglected idea and this cannot continue! If anything, the staff proposals willmake the situation worse and permanent. Offers of large building to providetiny park spaces, especially for their own residents and in the roof tops doesn’tserve the purpose and severely discounts the welfare of the North Venturaresidents as a whole. 5. Proposal for under parking is a disaster that has no justification. The excuse that the building will be within half a mile of a transit hub is just that, anexcuse. Where exactly will the residents of these buildings be commuting towith their access to trains. With units being small, they are not meant forfamilies with children. Are we to believe that this building will be theequivalent to a bedroom community? Where exactly will the residents of the tall building with inadequate parking, park in their cars? Oh, never mind Iforgot, they don’t own cars. Unfortunately this is more of a bad joke than what the reality is going to be! These cars, with no proper parkingwill start spilling over into the North Venturaneighborhoods, something the local residents will have todeal with, after the “ developers “ have made their moneyand moved on ! Under parking of retail areas as proposed by the staff, which once again the needs of the tenants as well as customers – the onlypeople who benefit are the “ developers “, who have moved on with the profitin their pockets. The rest of us will be left holding the proverbial “ Bag “. 6. The question of the importance of traffic appears to have been completely forgotten. Instead of it being one of the principal points of concern for theneighborhood traffic congestion with the proposed dense housing as well asreduced parking that retail and offices are going to be saddled with. Staff needsto go back to the drawing board that gives the right priority to the question oftraffic. Taller buildings are definitely not what will be preferred in thisscenario! Replacing offices with modest (read low cost) scale housing will bethe appropriate solution for our neighborhood. A family representative said the charges against Powell should now be enhanced. “We’re calling on the District Attorney’s Office to upgrade the charges to murder now,” Karlin Chan, a community activist in New York City and a spokesman for Ma’s family, told The Associated Press. “We're fighting for justice and I hope (Powell) never walks the streets as a free man. He needs to pay for what he did." The Legal Aid Society, which previously represented Powell, said he is no longer a client. A message was left seeking comment with another attorney listed in court records as Powell's lawyer. Powell attacked Ma from behind, knocking him to the ground and repeatedly kicking his head before fleeing the scene, prosecutors say. Surveillance video released by the police appears to show an attacker stomping on Ma's head. Chan said Ma never regained consciousness after the attack and his condition continued to deteriorate over time. Ma was moved in and out of multiple facilities during the past eight months, ultimately dying in a long-term care center run by The New Jewish Home, Chan said. A funeral is being planned for sometime next week. A police detective said in a criminal complaint that Powell admitted to attacking an Asian man at the approximate time and location of the attack on Ma, stating he did so because the man had robbed him the day before. Chan, however, said the men had never met before. Ma and his wife- - who Chan said is “devastated” by what happened to her husband — immigrated to the U.S. in October 2018 from China, where Ma was a dim sum chef. After arriving in the U.S., Ma obtained work as a general kitchen worker at a Chinese restaurant, making pastries and performing other kitchen tasks. However, when the pandemic hit, Ma lost his job when the restaurant closed during lockdown. He hadn't worked long enough to qualify for unemployment benefits, Chan said. That prompted Ma and his wife, who also lost her job as a home health care attendant, to collect returnable bottles and cans to generate extra money for food, Chan said. “They were recent immigrants,” he said. “They really didn't have any savings.” The couple have two adult children, a son and daughter, who still live in China. Prior to the pandemic, Chan said the couple lost their Chinatown apartment in December 2019 to fire and had to move in with relatives. Residential – Our neighborhood development needs to reflect the viewpoints of our NV residents. We need residential zoning and building codes to be followed as they are within every neighborhood of Palo Alto. We should not make trade-offs to attract investment and development that we would not do in other neighborhoods, too. We need a balanced community that includes affordable housing, not just luxury housing. Environment – Per Canopy, South Palo Alto has less of a tree canopy than other areas of Palo Alto. We need funding and initiative to plant more trees to improve our environment. Furthermore, the Matadero Creek should be brought back to a natural state, similar to how it exists in Barron Park so it is publicly accessible. Pedestrian and Bicycling Access – Despite the increasing size of the NV community of residents and businesses, we are more bound as compared to other neighborhoods such as College Terrace. For example, there are two crossings to access the Cal Ave business district from NV, whereas there are at least 6 crossings from CT. We need additional crosswalk at Ash Street with a pedestrian HAWK signal across Page Mill similar as those across El Camino Real. The same holds true for crosswalks on ECR. There are few crosswalks across ECR as compared to other neighborhoods along ECR. Furthermore, there are some crosswalks in NV along ECR that have no crosswalk signal whatsoever. The crosswalk signals need to be optimized to allow pedestrians to cross first before car traffic. Other Vision Zero measures should be enacted, too. Lastly, in the spirit of diversity, equity, and inclusion we need an El Camino Real bike lane since many who bicycle through NV may not know where the safest bike routes are located, but they ride their bike on ECR just as car commuters do. Additional office space doesn't help the office/housing imbalance any more than the paltry open space being offered helps achieve the goal of 4 acres per 1,000 residents, aspired to in the comp plan. There are obvious concerns about what is considered open space; empty sight lines, median strips and rooftops shouldn't count, and in both of those areas, housing and open space, the recommended project digs the hole deeper. Please don't allow speculators and high-end developers to garner benefits over those needed by the residents, who have expressed they are open to abundant housing, mostly BMR, and require open spaces, preserves, and natural environment to breathe, relax, and enjoy this beautiful green city. Based on the many plan revisions the school has submitted, it’s clear that protecting trees has been a high priority. Castilleja has been very responsive to the Council’s and neighbors’ concerns. In particular, significant changes have been made to the pool and the parking garage in order to mitigate impacts on protected trees. The school has made revision after revision in response to valuable feedback, ultimately landing on a master plan that is aesthetically pleasing, sustainable, and mindful of reducing traffic. In reviewing the options before you, I hope you will support the following: Garage: I strongly support the garage with the capacity of 69 cars (vs. 52 cars). The 52 car limit seemed to be randomly suggested at a Council meeting, but 69 cars can be parked with no additional impact, AND it will allow the school to meet their required number of spaces without having to remove green space to do so. It would make no sense at all to require surface parking when the additional 17 cars can be parked below grade. Why not choose an option that moves as many cars as possible underground? This is the best solution for the neighborhood. Pool: Two options are before you, one that moves the pool to better protect tree 89 (but will require deliveries to be above ground). A second option moves a pool stairwell and transformer, still protects tree 89, and allows for below ground deliveries. I would think the second option is preferable. Bringing deliveries below grade reduces noise in the neighborhood, and that option still better protects tree 89 compared to the previous plan. What’s most obvious to me are the lengths the school has gone to respond to feedback, protect trees, and still meet the objectives of their project. This has been an interminable approval process, and I certainly hope this will be their final round of revisions. Years of professional review by multiple third parties support the approval of this project. Let’s listen to the facts and move forward. We are a broad coalition with a multi-generational membership, including new and longtime residents. PAF has consistently made public comments about the NVCAP. Over 4 years, several respected community organizations and members, including the Planning and Transportation Commission, have supported the most feasible alternative that helps create housing and fund community benefits. The public record documents a significant number of individuals and organizations who supported Alternative 3B and participated in NVCAP community meetings, but this has not been noted in the staff report. Palo Alto Forward also supports Alternative 3B, not Preferred Alternative 1 as recommended in the January 10th staff report. Both the staff and the economic consultants, Perkins & Will and Strategic Economics, have diligently researched and outlined potential results of the various scenarios over the planning period.Their analyses have been very good. Alternative 3B remains the best alternative because it has the greatest potential for addressing the housing crisis through the creation of housing. Up until this staff report (January 2022), staff consistently noted the advantages of Alternative 3 and to a lesser degree Alternative 2. The focus was on feasibility, community benefits, and affordable housing options. The Preferred Alternative 1 is inadequate to enhance the environmental, public health, housing, and economic vitality of our town. For example, Preferred Alternative 1 would likely yield one-fourth of the housing units that would be possible through Alternative 3B. Our housing needs are not met through the Preferred Alternative 1. As we have stated previously, Alternative 3B is the best alternative because it creates: 1. An inclusive neighborhood for residents of all income levels while requiring the least public funding. 2. A healthier and sustainable neighborhood by incentivizing public transit and bicycle/pedestrian use. It addresses our climate change goals (S/CAP) by incentivizing public transit use through the reduction of parking minimums (which also reduces development costs). 3. An engaging overall design by promoting flexibility in building heights, density, and the creation of open space. 4. A community that addresses current and future neighborhoods and that values diversity, equity, and inclusion. 5. A more balanced mix of office, commercial, and residential uses to complement the economic viability of the NVCAP area, California Avenue, Page Mill/Oregon and El Camino Real. Additionally, the NVCAP area is close to services, shopping, transit, and jobs, which would set new families and low-income residents up for success. In order to ensure this happens, we must adjust our height limits, parking policies, fees, and floor-area ratios to accommodate more homes and make it economically feasible to build. Adopting Alternative 3B rather than Preferred Alternative #1 would enhance our ability to meet our RHNA goals. We hope the Housing Element Working Group demonstrates how we can identify more feasible sites and create policies that truly result in housing and amenities. The recent Santa Clara County Civil Grand Jury Report (December 2021) report identifies many City impediments to sensible and creative housing options, including cumbersome review, the limited use of precise or area-specific plans with development standards and tailored zoning that simplify and expedite review, uncertainty of outcomes for applicants, lack of broader and informed engagement in the process, and other impediments to balanced development scenarios (See Recommendations 3, 4, 6a, 6b, and 9).
